REGULAR MEETING JULY 20 1992 ADOPT RESOLUTION NO. 29-1992 - RELEASE OF LEASE Board Attorney and Member Mary H. Mueller advised that Resolution No. 29-1992 has been prepared and submitted to the Board for adoption. The Resolution releases a fifty (50) year lease which the City entered into with the Fraternal Order of Police on June 9, 1958. Mrs. Mueller noted that the area leased was to be used as the Police Department pistol range and is located north of Corpus Christi Church and has not been used for years. Therefore, Mr. Caldwell made a motion that the Resolution be adopted. Mrs. Mueller seconded the motion which carried and the following Resolution No. 29-1992 was adopted: RESOLUTION NO. 29-1992 A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS WHEREAS, on June 9, 1958, the Municipal City of South Bend acting through its Board of Public Works, entered into a fifty (50) year Lease with the Fraternal Order of Police for the lease of certain property in St. Joseph County, Indiana. A copy of said Lease is attached hereto as Exhibit "A"; and WHEREAS, the Fraternal Order of Police intended to use said land as a shooting range for the active and retired police officers of the City of South Bend who are members of the Fraternal Order of Police; and WHEREAS, since June 9, 1958, the Fraternal Order of Police, Lodge No. 36, has acquired other land for use as a pistol range, is using said land for a pistol range, and has no use for the land which is the subject of the June 9, 1958, Lease; and WHEREAS, the Fraternal Order of Police has requested that the Lease be terminated. NOW, THEREFORE, this Board agrees to dissolve the Lease with the Fraternal Order of Police for the following described property: Beginning on the east and west centerline of Section 27, Township 38 North, Range 2 East, a distance of 1430.6 feet each of the west quarter corner of said Section 27; thence North 445 feet; thence East parallel to and with the said east and west centerline of said section a distance of 723.3 feet; thence South 445 feet to said centerline of Section 27; thence West 723.3 feet to the place of beginning. This tract is located in the Northwest quarter Section 27, Township 38 North, Range 2 East, German Township, St. Joseph County, Indiana, and contains 7.36 acres more or less. NOW, THEREFORE, BE IT RESOLVED, all parties are released from any and all obligations under the Lease. Dated this 20th day of July, 1992.
