REGULAR MEETING JULY 20, 1992 <br />Therefore, Mr. Caldwell made a motion that the Agreement be <br />approved and executed. Mrs. Mueller seconded the motion which <br />carried. <br />APPROVE REIMBURSEMENT CONTRACT - WESTGATE COVE SUBDIVISION <br />Mr. Leszczynski advised that the Division of Engineering, has <br />submitted to the Board a Reimbursement Contract for water and <br />sewer for Westgate Cove Subdivision and recommended that the <br />Board accept this Contract. Both water and sewer have been <br />installed as follows: <br />Service Location <br />Water Westgate Dr. Easement <br />North of Lots 6 & 7 Westgate Cove <br />Sewer Westgate Dr. Easement <br />North of Lots 6 & 7 Westgate Cove <br />Mr. Leszczynski noted that this Contract provides that Garden <br />Homes by Leroy Yoder will be reimbursed when someone taps into <br />the water and sewer main. <br />Board Attorney and Member Mary H. Mueller noted that this is the <br />standard Water Works form and that it is expected that only one <br />(1) person will tap into the system. <br />Mr. Leszczynski made a motion that the Contract be approved. <br />Mrs. Mueller seconded the motion which carried. <br />FILING OF PUBLIC DISCLOSURE OF A DETERMINATION OF CONFLICT OF <br />INTEREST <br />In a letter to the Board, Mr. Jon R. Hunt, Executive Director, <br />Department of Economic Development, advised that submission of <br />his letter, to be received and filed at a public meeting of the <br />Board of Public Works of the City of South Bend, Indiana, will <br />serve as public disclosure of a determination of conflict of <br />interest under 24 CFR 570.611 for Pat Lynch, a part-time member <br />of the South Bend Heritage Foundation. <br />Mr. Hunt noted that Ms. Lynch has applied for grant assistance in <br />a West Washington area slum/blight activity which is being <br />managed by South Bend Heritage. The source of these funds is the <br />Community Development Block Grant (CDBG) program. The grant <br />represents an approximate thirteen per cent (13%) contribution to <br />the estimated costs of relocation and rehabilitation of a vacant, <br />historically significant, residential structure. Without grant <br />assistance, the structure will in all likelihood be demolished <br />late summer of 1992 as the Northern Indiana Historical Society <br />prepares the lot for its new History Center development. <br />Mr. Hunt further noted that public consideration and acceptance <br />of his letter satisfies the Department of Housing and Urban <br />Development's (HUD) regulations which require public disclosure <br />of any potential conflict of interest involving the use of CDBG <br />funds. This is a required step toward gaining HUD approval of <br />the transaction. <br />It was noted that the office of the South Bend City Attorney has <br />determined that the above situation does not constitute a <br />conflict of interest under state law. This office will be <br />requesting a waiver from the United States Department of Housing <br />and Urban Development, Indianapolis area office, pursuant to 24 <br />CFR 570.611. <br />Mr. Leszczynski made a motion that the letter as submitted be <br />accepted for filing. Mrs. Mueller seconded the motion which <br />carried. <br />
