REGULAR MEETING JUNE 22, 1992 <br />$25,267.50 for the above referred to project, a Contract in said <br />amount was submitted for Board approval. Upon a motion made by <br />Mrs. Mueller, seconded by Mr. Caldwell and carried, the Contract <br />was approved and the appropriate Certificate of Insurance, <br />Performance Bond and Labor and Materials Payment Bond as <br />submitted were filed. <br />APPROVE COMMUNITY DEVELOPMENT CONTRACT/ADDENDUM <br />Mr. Caldwell advised that the following Community Development <br />Contract and Addendum were presented to the Board for approval: <br />'0Ti lk"Ae�ir <br />SOUTH BEND HERITAGE FOUNDATION <br />WEST WASHINGTON PUBLIC WORKS ACTIVITY <br />The targeted goal for this activity is to make infrastructure <br />improvements in the 1200 block of West Washington Street in <br />conjunction with the construction of new low and moderate <br />income housing. The total'cost of this activity shall not <br />exceed $100,000.00. <br />ADDENDUM I <br />DIVISION OF ECONOMIC DEVELOPMENT AND BUSINESS ASSISTANCE <br />WEST WASHINGTON PUBLIC WORKS ACTIVITY <br />Addendum I terminates the West Washington Public Works <br />Activity with Economic Development and Business Assistance. <br />Upon a motion made by Mr. Caldwell, seconded by Mrs. Mueller and <br />carried, the Contract as outlined above was approved and <br />executed. Further, upon a motion made by Mr. Caldwell, seconded <br />by Mrs. Mueller and carried, the Addendum as submitted was <br />approved. <br />APPROVE GRANT OF EASEMENT - NATIONAL AUTOPARK, INC., <br />Mr. James A. Masters, Attorney at Law, Nemeth, Masters & Leone, <br />Suite 307, Norwest Bank Building, 112 West Jefferson Boulevard, <br />South Bend, Indiana, addressed the Board and advised that <br />National Autopark, Inc., which is a wholly -owned subsidiary of <br />Norwest Bank Indiana, N.A., requests approval of a Grant of <br />Easement for the parking garage located at the intersection of <br />Main and Wayne Streets. <br />Mr. Masters further advised that when the parking garage was <br />constructed in 1965, an above -ground pedestrian walkway was <br />constructed connecting the second and third floors of the parking <br />garage to the second and third floors of what is now known as the <br />Norwest Bank Building and the Robertson's Department Store <br />building. An underground tunnel also was constructed which <br />connects the basement of the parking garage to the basement of <br />the Norwest Bank Building. A title search reveals that there is <br />no public record of an Easement having been granted by the City <br />of South Bend for the pedestrian walkway over the public alley to <br />the east of the parking garage or the tunnel which runs under the <br />public alley. Recent surveys of the parking garage also show <br />certain encroachments onto the public right-of-ways. Copies of <br />the surveys were provided by Mr. Masters and reduced copies of <br />the surveys were also attached to the Grant of Easement which was <br />prepared and also submitted. <br />Mr. Masters stated that National Autopark, Inc., is in the <br />process of transferring title to the parking garage. In <br />conjunction with the closing, the purchaser has requested the <br />proposed Grant of Easement for the pedestrian walkway and <br />underground tunnel and for the building encroachments shown on <br />the survey. The survey revealed encroachments onto the public <br />right-of-way on the northwest corner of the parking garage and on <br />the alley between the garage and the Federal Courthouse.
