REGULAR MEETING MARCH 16, 1992 <br />the requirement that an office be open twenty-four (24) hours a <br />day for dispatching purposes. <br />Mrs. Mueller stated that it is her understanding that a Public <br />Hearing was held by the Board on March 2, 1992 regarding this <br />application. She advised that it is the decision of the <br />Controller's office whether the applicant meets the requirements <br />of the ordinance and the Board's decision will be based on the <br />issue of public convenience and necessity. <br />Therefore, Mr. Caldwell made a motion that the application be <br />approved. Mrs. Mueller seconded the motion which carried. <br />In response to an inquiry from the news media, Mrs. Mueller <br />reiterated that the Controllers office will decide all of the <br />technical matters and that the Board of Public Works only decides <br />whether there is a need for this public convenience and <br />necessity. She stated that testimony was given at the Public <br />Hearing that there are times when people have to wait for a <br />taxicab. <br />BEND <br />TION TABLED - VACATION OF 1ST E <br />10 <br />Mr. Leszczynski advised that <br />Attorney Kenneth P. Fedder, <br />300, South Bend, Indiana, on <br />Notre Dame Avenue, South Ben <br />alley has been submitted to <br />A <br />ALLEY SOUTH OF SOUTH <br />a Vacation Petition as filed by <br />205 West Jefferson Boulevard, Suite <br />behalf of Mahmoud A. Hussein, 744 <br />d, Indiana, to vacate the following <br />the Board for recommendation: <br />The 1st east/west alley south of South Bend Avenue <br />running east from Notre Dame Avenue, for a distance <br />of approximately 150.38 feet to a point which is <br />approximately 10 feet west of the lst north/south <br />alley east of Notre Dame Avenue, all in "Sorin's <br />1st Addition to the Town of Lowell." <br />Mrs. Mueller inquired if a recommendation has been received from <br />the Department of Code Enforcement concerning this Petition. As <br />they had not been asked for their recommendation, Mrs. Mueller <br />made a motion that the Board table making a recommendation <br />concerning this Vacation Petition until the Department of Code <br />Enforcement is able to provide their recommendation to the <br />Board.
