REGULAR MEETING FEBRUARY 24, 1992 <br />RESOLUTION NO. 9-1992 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND AUTHORIZING THE <br />DEPARTMENT OF CODE ENFORCEMENT TO INSPECT THE <br />CITY'S SIDEWALKS AND ITS TREE AND LAWN AREAS AND <br />TO REMOVE SIGNS, VEHICLES, STRUCTURES AND OTHER <br />OBJECTS IMPROPERLY PLACED THEREON <br />WHEREAS, the Board of Public Works of the City of South Bend <br />is vested with the custody and responsibility to maintain the <br />public lands and right-of-ways within the City; and <br />WHEREAS, pursuant to Indiana Code 36-9-6-15, the Board of <br />Public Works may order the removal of any structure improperly <br />placed in any public land or right-of-way of the City; and <br />WHEREAS, "structure" is defined as any piece of work <br />artificially built up or composed of parts joined together in <br />some definite manner, and therefore, includes such items as <br />signs, vehicles, trailers, boats, and other such objects; and <br />WHEREAS, the Department of Code Enforcement has advised the <br />Board of Public Works that signs, vehicles, boats, trailers, and <br />other objects are often improperly placed or stored upon the <br />City's sidewalks and tree and lawn areas; and <br />WHEREAS, the City's Department of Code Enforcement has the <br />personnel and wherewithal to provide for the removal of such <br />objects that are improperly placed upon the public right-of-way; <br />and <br />WHEREAS, the Board of Public Works is interested in obtaining <br />the prompt removal of such improperly placed objects and <br />structures and desires to authorize the Department of Code <br />Enforcement to inspect the City's sidewalks and tree and lawn <br />areas and to remove any items improperly placed thereon on behalf <br />of the Board of Public Works. <br />NOW, THEREFORE, IT IS RESOLVED AS FOLLOWS: <br />1. The Board of Public Works of the City of South Bend <br />hereby authorizes the City's Department of Code Enforcement to <br />inspect the sidewalks and tree and lawn areas of the City and to <br />remove any items, including private and commercial signs, <br />vehicles, trailers, boats, structures and objects of any type <br />whatsoever that are improperly placed thereon. <br />2. The Department of Code Enforcement is authorized to <br />remove, without notice, any sign or other object that might <br />disrupt traffic or be a danger or hazard to the public utilizing <br />the sidewalk or tree and lawn area. <br />3. The Department of Code Enforcement is authorized to <br />remove other objects improperly placed on sidewalks and tree and <br />lawn areas after giving forty-eight (48) hours written notice to <br />the property owner that such objects will be removed by the City. <br />This Resolution is adopted this 24th day of February, 1992. <br />s/John Leszczynski <br />s/Patricia DeClercq <br />s/James R.
