Meuller informed members of the Board that
I.C. 36-9-6-15 gives the Board of Public Works jurisdiction over
right-of-way. As the Board has a hard time policing the public
rights -of -way a Resolution has been prepared that authorizes the
Department of Code Enforcement to inspect the sidewalks and tree
and lawn areas and to remove any items that are improperly
placed. These items may include signs, automobiles and boats.
The Resolution provides that the Department of Code Enforcement
will be authorized to remove any object that might disrupt
traffic or be a danger or hazard to the public without notice.
However, all other items will be removed only after giving the
property owner forty-eight (48) hours notice.
Mrs. Patricia E. DeClercq, Director, Department of Code
Enforcement, advised that the Department of Code Enforcement does
receive many calls concerning objects in the right-of-way. Mrs.
DeClercq stated that she is pleased that a policy has been
created that will assist the Department in dealing with these
concerns in a timely manner.
Therefore, Mrs. DeClercq made a motion that the Resolution as
prepared and submitted be adopted. Mr. Caldwell seconded the
motion which carried and the following Resolution No. 9-1992 was
adopted:
L
E
1
