REGULAR MEETING <br />MARCH 29, 1993 <br />WHEREAS, the Board of Public Works of the City of South Bend, <br />Indiana, and the Common Council of the City approved plans, <br />specifications and cost estimates for the acquisition and <br />construction of certain improvements to the City's sewer utility; <br />and <br />WHEREAS, the Board of Public Works and Common Council of the <br />City approved an Ordinance for the financing of such improvements, <br />being Ordinance No. 7951-88, pursuant to which were issued the <br />bonds designated as "Sewage Works Revenue Bonds of 198911, dated <br />February 1, 1989, issued in original aggregate principal amount of <br />Nine Million Five Hundred Thousand Dollars ($9,500,000) (the 111989 <br />Bonds"), and <br />WHEREAS, a surplus exists from proceeds of the 1989 Bonds and <br />investment earnings thereon in the City of South Bend Sewage Works <br />Construction Fund created by said Ordinance No. 7951-88, said <br />surplus being an amount in excess of the amount needed to complete <br />the projects contemplated by said Ordinance; and <br />WHEREAS, said surplus was not anticipated at the time of the <br />issuance of the 1989 Bonds; and <br />WHEREAS, the Board of Public Works deems it advisable to <br />apply said surplus to additional improvements to the City's sewage <br />works as more particularly described on Exhibit A attached hereto. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works <br />for the City of South Bend that the use of said surplus and any <br />further investment earnings thereon for the purposes described on <br />Exhibit A is hereby approved. <br />This Resolution shall be in full force and effect after its <br />adoption by the Board of Public Works. <br />ADOPTED at a meeting of the City of South Bend Board of <br />Public Works on this 29th day of March, 1993. <br />ATTEST: <br />s/Sandra M. Caldwell, Member <br />s/Mary Hall Mueller, Member <br />EXHIBIT "A" <br />The engineering design work consisting of preliminary <br />engineering design, final construction drawings, preparation of <br />specification and bid packets, as well as appurtenant work for the <br />following public improvements: <br />The construction of a new storm water retention basin <br />immediately north of the Erskine Park golf course in the <br />City of South Bend, Indiana, the construction of a <br />grassed waterway through the Erskine Park golf course, <br />and the construction of a new storm water sewer within <br />and along the Chippewa Avenue right of way north of the <br />Erskine Park golf course, all over, under and upon <br />property owned by the City of South Bend, Indiana and/or <br />right-of-way dedicated to the City of South Bend, <br />Indiana for such purposes. <br />rJ <br />
