REGULAR MEETING MARCH 29, 1993 WHEREAS, the Board of Public Works of the City of South Bend, Indiana, and the Common Council of the City approved plans, specifications and cost estimates for the acquisition and construction of certain improvements to the City's sewer utility; and WHEREAS, the Board of Public Works and Common Council of the City approved an Ordinance for the financing of such improvements, being Ordinance No. 7951-88, pursuant to which were issued the bonds designated as "Sewage Works Revenue Bonds of 198911, dated February 1, 1989, issued in original aggregate principal amount of Nine Million Five Hundred Thousand Dollars ($9,500,000) (the 111989 Bonds"), and WHEREAS, a surplus exists from proceeds of the 1989 Bonds and investment earnings thereon in the City of South Bend Sewage Works Construction Fund created by said Ordinance No. 7951-88, said surplus being an amount in excess of the amount needed to complete the projects contemplated by said Ordinance; and WHEREAS, said surplus was not anticipated at the time of the issuance of the 1989 Bonds; and WHEREAS, the Board of Public Works deems it advisable to apply said surplus to additional improvements to the City's sewage works as more particularly described on Exhibit A attached hereto. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works for the City of South Bend that the use of said surplus and any further investment earnings thereon for the purposes described on Exhibit A is hereby approved. This Resolution shall be in full force and effect after its adoption by the Board of Public Works. Caldwell, Member s/Mary Hall Mueller, Member EXHIBIT "A" The engineering design work consisting of preliminary engineering design, final construction drawings, preparation of specification and bid packets, as well as appurtenant work for the following public improvements: The construction of a new storm water retention basin immediately north of the Erskine Park golf course in the City of South Bend, Indiana, the construction of a grassed waterway through the Erskine Park golf course, and the construction of a new storm water sewer within and along the Chippewa Avenue right of way north of the Erskine Park golf course, all over, under and upon property owned by the City of South Bend, Indiana and/or right-of-way dedicated to the City of South Bend, Indiana for such purposes. rJ
