r. <br />REGULAR MEETING <br />FEBRUARY 1, 1993 <br />0 5 <br />WHEREAS, in 1966, the City of South Bend sold and transferred <br />a parcel of land to Matthew R. Dee described as Parcel No. 3 to <br />the Inner Belt Industrial Park, commonly known as 840 Prairie <br />Avenue; and <br />WHEREAS, the legal description of the property conveyed <br />differed from the description as shown on the plat in that a <br />strip approximately 6.5 foot in width on the eastern boundary of <br />the property was not included in the legal description; and <br />WHEREAS, it was the intent of both the City and the purchaser <br />that all of the land shown on the plat as being part of Parcel <br />No.-3 should be conveyed, as is evidenced by a fence erected by <br />the City along the boundary line as shown on the plat; and <br />WHEREAS, the purchaser has paid real estate taxes on Parcel <br />No. 3 since the date of purchase, including the 6.5 foot strip <br />that is the subject of this Resolution; and <br />WHEREAS, it is necessary and appropriate to resolve the <br />ambiguity between the property line as shown on the plat and as <br />described. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works <br />of the City of South Bend, Indiana, as follows: <br />1) The City shall transfer to Matthew R. Dee a parcel of <br />real estate as shown on the attached Exhibit and more <br />particularly described as follows: <br />A parcel of land beginning at the South East <br />corner of Parcel No. 3 in the Inner Belt <br />Industrial Park, a Subdivision in the <br />Southeast and Southwest quarters of Section <br />11 and the Northeast quarter of Section 14, <br />all in Township 37 North, Range 2 East of the <br />Second Principal Meridian, City of South <br />Bend, Indiana, the Plat of which is recorded <br />in Plat Book 21, Page I in the Office of the <br />Recorder of St. Joseph County, Indiana, and <br />thence North along the East boundary line of <br />Parcel No. 3, 29, 34127" East, a distance of <br />505.36 feet, thence East along the street <br />line of Prairie Avenue 13', thence South 29, <br />34'27" West a distance of 513.77', thence West to the <br />point of beginning. <br />2) Such transfer shall be accomplished by quit -claim deed, <br />executed by the Mayor of the City of South Bend and attested to <br />by the South Bend City Clerk. <br />Adopted this 1st day of February, 1993. <br />CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS <br />s/John Leszczynski, President <br />s/James R.
