r. REGULAR MEETING FEBRUARY 1, 1993 0 5 WHEREAS, in 1966, the City of South Bend sold and transferred a parcel of land to Matthew R. Dee described as Parcel No. 3 to the Inner Belt Industrial Park, commonly known as 840 Prairie Avenue; and WHEREAS, the legal description of the property conveyed differed from the description as shown on the plat in that a strip approximately 6.5 foot in width on the eastern boundary of the property was not included in the legal description; and WHEREAS, it was the intent of both the City and the purchaser that all of the land shown on the plat as being part of Parcel No.-3 should be conveyed, as is evidenced by a fence erected by the City along the boundary line as shown on the plat; and WHEREAS, the purchaser has paid real estate taxes on Parcel No. 3 since the date of purchase, including the 6.5 foot strip that is the subject of this Resolution; and WHEREAS, it is necessary and appropriate to resolve the ambiguity between the property line as shown on the plat and as described. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend, Indiana, as follows: 1) The City shall transfer to Matthew R. Dee a parcel of real estate as shown on the attached Exhibit and more particularly described as follows: A parcel of land beginning at the South East corner of Parcel No. 3 in the Inner Belt Industrial Park, a Subdivision in the Southeast and Southwest quarters of Section 11 and the Northeast quarter of Section 14, all in Township 37 North, Range 2 East of the Second Principal Meridian, City of South Bend, Indiana, the Plat of which is recorded in Plat Book 21, Page I in the Office of the Recorder of St. Joseph County, Indiana, and thence North along the East boundary line of Parcel No. 3, 29, 34127" East, a distance of 505.36 feet, thence East along the street line of Prairie Avenue 13', thence South 29, 34'27" West a distance of 513.77', thence West to the point of beginning. 2) Such transfer shall be accomplished by quit -claim deed, executed by the Mayor of the City of South Bend and attested to by the South Bend City Clerk.
