REGULAR MEETING DECEMBER 12, 1994 <br />APPROVE LICENSE APPLICATION - PUBLIC PARKING FACILITY <br />Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the following license <br />application was approved: <br />Memorial Health Care Parking Services <br />Lafayette Street and Bartlett Street <br />South Bend, Indiana <br />The above license application was approved and referred to the Deputy Controller's Office for <br />issuance of a license. It was noted that the required Proof of Insurance as well as the hours and rates <br />to be charged was attached to the application. <br />FILE PETITION FOR RESERVED PARKING AREA <br />Mr. Caldwell stated that the Board is in receipt of a Petition for Reserved Parking Area, as submitted <br />by Ms. Sharon Brown, 5910 Winamac Lake Drive, Apt. 1B, Mishawaka, Indiana. Upon a motion <br />made by Mr. Caldwell, seconded by Mrs. Manier and carried, the Petition for Reserved Parking Area <br />was referred to the appropriate Bureaus for recommendation. <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE <br />Mr. Caldwell stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to <br />Remonstrate as submitted by Mr. Kevin T. Brugh and Ms. Janice Platz. The Consent indicates that <br />in consideration for permission to tap into the public sanitary sewer system of the City, to provide <br />sanitary sewer service to 19856 Jewell Avenue, South Bend, Indiana, (Key # 01-1060-1717), Mr. <br />Brugh and Ms. Platz waive and release any and all right to remonstrate against or oppose any <br />pending or future annexation of the property by the City of South Bend. Therefore, Mr. Caldwell <br />made a motion that the Consent be approved. Mrs. Manier seconded the motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE PUBLIC RIGHT-OF-WAYS <br />Mr. Caldwell indicated that the Common Council has submitted to the Board a Vacation Petition as <br />completed by Mr. Jon R. Hunt, Director, Department of Community and Economic Development, <br />to vacate the following public right of ways: <br />Keasey Street from Michigan Street to Carroll Street. Some north/south and east/west alleys situated <br />between Michigan Street and Carroll Street, and Ohio Street and vacated Elder Street. All more <br />particularly described as follows. <br />STATEMENT OF PURPOSE AND INTENT <br />Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority <br />to hear all petitions to vacate public ways or public places within the City. <br />The following ordinance vacates the above described public property. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF <br />SOUTH BEND, INDIANA, as follows: <br />SECTION I. The Common Council of the City of South Bend having held a public hearing on <br />the petition to vacate the following property: <br />Description of Vacation of a 14' Wide Alley <br />A parcel of land located in the Northwest Quarter (NW '/4) of Section Thirteen (13), Township <br />Thirty -Seven (37) North, Range Two (02) East and all being in Portage Township, City of South <br />Bend, St. Joseph County, Indiana and as shown on the following subdivision plats; Elder Place - <br />Book 5, Page 13, Joseph Keasey - Book 2, Page 69 and Adam S. Baker's 1st Addition to the City <br />of South Bend - Book 4, Page 35, said parcel being a 14 foot wide public alley and being 7.0 feet <br />each side of the following described centerline: <br />
