REGULAR MEETING NOVEMBER 21. 1994 <br />Committee. Additionally, an Indemnification and Hold Harmless Undertaking prepared by the Legal <br />Department has been signed. It is to be noted that the Division of Engineering has recommended <br />that the height requirement of the installation of the three (3) awnings is to be nine (9) feet, in order <br />to have sufficient clearance for snow removal equipment, operated by the Park Department. <br />Therefore, Mrs. Manier made a motion to approve the recommendation. Mr. Caldwell seconded the <br />motion which carried, subject to the recommendation from the Division of Engineering. <br />APPROVAL OF RECOMMENDATION TO CLOSE MICHIGAN STREET BETWEEN <br />JEFFERSON AND WAYNE STREETS FOR "DOWNTOWN FOR THE HOLIDAYS" <br />Mr. Leszczynski noted that the Board is in receipt of favorable recommendations from the Police <br />Department, Legal Department, Division of Engineering and the Park Department for a request to <br />close Michigan Street between Jefferson and Wayne Streets, on Friday December 2, 1994 from 3:30 <br />p.m. to 7:00 p.m., and Saturday, December 3, 1994, from 6:00 a.m. to 9:00 a.m., to conduct <br />"Downtown for the Holidays". Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier <br />and carried, the recommendation was approved. <br />APPROVAL OF RESOLUTION NO. 45-1994 - DISPOSAL OF CERTAIN PERSONAL <br />PROPERTY - (FENCING) <br />Mr. Leszczynski noted that the Board is in receipt of a request from Mr. Bruce L. Gordon, 1128 N. <br />Lafayette, South Bend, Indiana, indicating his interest in purchasing thirty (30) feet of fencing <br />located at 1505 S. Catalpa, which is City -owned property. Additionally, Mr. Gordon stated that he <br />will remove the fence and haul it away at his own expense, for a sum of one hundred ($100.00) <br />dollars. Further, Mr. Leszczynski stated that the Board is in receipt of favorable recommendations <br />from the Department of Public Works, Code Enforcement, Community and Economic Development <br />and the Park Department. Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and <br />carried, Resolution No. 45-1994 was approved: <br />RESOLUTION NO.45-1994 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />THE CITY OF SOUTH BEND, INDIANA, <br />DISPOSING OF CERTAIN PERSONAL PROPERTY <br />WHEREAS, the City of South Bend, Indiana, is the owner of a parcel of real estate <br />commonly known as 1505 South Catalpa; and <br />WHEREAS, located upon this real estate is a wrought iron fence; and <br />WHEREAS, the care, custody and control of City -owned personal property is vested in the <br />Board of Public Works pursuant to I.C. 36-9-6-3; and <br />WHEREAS, it has been determined by the Board of Public Works that the fence located on <br />the property is no longer of use to the City of South Bend; and <br />WHEREAS, I.C. 36-1-11-6 (c) permits and establishes a procedure for disposal of property <br />which is unfit for the purpose for which it was intended and is no longer need by the City. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South <br />Bend, Indiana, that the fence located on the Property at 1505 South Catalpa is unfit for the purpose <br />for which it was acquired, is no longer of use to the City of South Bend, and has an estimated value <br />of less that One Thousand Dollars ($1,000.00). <br />BE IT FURTHER RESOLVED, that the fence should be sold to BRUCE L. GORDON for <br />One Hundred Dollars ($100.00), and that BRUCE L. GORDON will remove the fence and haul it <br />away at his own expense. <br />
