44 <br />REGULAR MEETING AUGUST 22, 1994 <br />operate this business out of his residence at 5019 Bloomfield <br />Place and was previously told by the Department of Code <br />Enforcement that that would be acceptable. He noted that <br />previously it was acceptable to operate the business anywhere as <br />long as drivers were dispatched twenty-four (24) hours a day. <br />Mr. Jones advised that he intends to call his new business the ABC <br />Cab and Courier Service. He noted that he did not put the number <br />of vehicles he intends to operate on the license application. He <br />stated that he recalls that the Board has not set a limit on the <br />number of taxicabs a business can operate as the market will <br />dictate that amount. <br />Mr. Jones asked that the Board let him operate and fail or be <br />successful. It is his opinion that the City will support more <br />taxicabs. Mr. Jones stated that the trouble is getting drivers <br />and he intends to recruit and train more drivers. <br />Mr. Pat O'Connell, Attorney at Law, 131 South Taylor Street, South <br />Bend, Indiana, representing Yellow Cab Company, 710 North Niles <br />Avenue, South Bend, Indiana, was present and noted that the <br />application submitted by Mr. and Mrs. Jones does not contain <br />answers to the question regarding the net worth of the business. <br />Mr. O'Connell further stated that it is his understanding that the <br />present ordinance is, and has been, in the process of being <br />reviewed. Mr. O'Connell stated that he would suggest that until <br />the ordinance is worked out it would not be appropriate to <br />undertake licensing any other companies. <br />Ms. Darlene Horvath, Office Manager, Yellow Cab Company, addressed <br />the Board and stated that she believes there is not a need for <br />another cab company to operate in the area. Yellow Cab keeps <br />track of the calls coming in and the business is growing. But, <br />who will protect the future. Ms. Horvath also disputed the claim <br />made by Mr. Jones that drivers are not available to drive taxicabs <br />and she noted that they do come in to Yellow Cab to drive. <br />Ms. Horvath noted that Yellow Cab Company is the largest in the <br />area and they are taking care of their customers. She further <br />noted that there is a slow season in this business. <br />In regards to the provision of services to the disabled, <br />handicapped or elderly, Ms. Horvath stated that it is her <br />understanding that TRANSPO Access is handling that business <br />adequately. Ms. Horvath also stated that Yellow Cab and other cab <br />companies do handle Medicaid runs but it is a lot of work and they <br />must be careful. <br />Ms. Horvath informed the Board that it has also come to her <br />attention that there are "gypsy" cabs operating in South Bend <br />without the appropriate license. She noted that Mr. Jones has <br />been operating without a license. She also noted that these <br />"gypsy" cab companies slap on a magnetic sign and handle the <br />business from the Century Center, Notre Dame and the hotels and <br />motels. She stated that all companies operating should be made to <br />follow the rules of the City. <br />Mr. Roger Woods, Roseland Cab Company, P.O. Box 643, Notre <br />Dame, <br />Indiana, addressed the Board and stated that he and Mr. Jones have <br />been friends for twelve (12) years. Mr. Woods stated that in the <br />past he recalls the Board saying that they would not approve any <br />more cab companies. However, that has not been the case. Mr. <br />Woods stated that ninety per cent (90%) of his business is in <br />Roseland. Mr. Woods further informed the Board that there are <br />companies licensed by the City that are not operating. He stated <br />that United Limo has never operated a true cab company. He <br />reminded the Board that the ordinance indicates that the Board can <br />revoke licenses when necessary. Mr. Woods noted that he has at <br />
