3 <br />REGULAR MEETING <br />AUGUST 22, 1994 <br />drive a vehicle and will provide service to the elderly and <br />disabled. <br />Board Attorney Mrs. Anne Bruneel informed Mr. Schoby that pursuant <br />to the licensing ordinance, the business must be available twenty- <br />four (24) hours a day to receive calls. Mr. Schoby stated that <br />that would not be a problem. Mr. Leszczynski inquired of Mr. <br />Schoby how he would provide this service when he previously stated <br />that he would not. Mr. Schoby replied that he was not aware that <br />that was an ordinance requirement but can comply with this <br />requirement. <br />Mr. Roger Woods, Roseland Cab Company, P.O. Box 643, Notre Dame, <br />Indiana, stated that he is confused as to Mr. Schoby's intentions. <br />Is he going to service the public or pick out the ones he wants to <br />service. Mr. Woods stated that pursuant to the ordinance, service <br />must be provided twenty-four (24) hours a day, seven (7) days a <br />week. <br />Mr. Woods informed the Board that if Mr. Schoby intends to service <br />only the elderly and Medicaid recipients, there are lots of vans <br />in service operating without a taxi license because they are <br />regulated by the State. If the state requirements are met a City <br />license is not required. Mr. Woods stated that if Mr. Schoby <br />intends to operate as a taxi he must work like a taxi. <br />Mrs. Bruneel read part of the licensing ordinance to Mr. Schoby <br />that indicates that all persons engaged in the taxicab business in <br />the City, operating under the provision of the ordinance, shall <br />render an overall service to the public desiring to use taxicabs. <br />Mrs. Bruneel further stated that Mr. Schoby must be available to <br />handle calls twenty-four (24) hours a day. <br />Mr. Schoby informed the Board that he has no problem with the <br />requirements as outlined to him today. Mr. Caldwell further <br />informed Mr. Schoby that he will have to install meters in his <br />vans. <br />Mr. Caldwell made a motion that the Board table the application of <br />Mr. Schoby and continue the Public Hearing until September 6, 1994 <br />at 9:30 a.m. in order to give Mr. Schoby time to meet with Board <br />Attorney Anne Bruneel to go over the taxicab licensing ordinance. <br />Mr. Leszczynski seconded the motion which carried. <br />PUBLIC HEARING AND CONTINUATION - CERTIFICATE OF PUBLIC <br />CONVENIENCE AND NECESSITY - WALTER AND PATRICIA JONES <br />Mr. Leszczynski indicated that submitted to the Board for <br />consideration was an Application for Certificate of Public <br />Convenience as submitted by Walter and Patricia Jones, 5019 <br />Bloomfield Place, South Bend, Indiana. <br />It is noted that pursuant to ordinance requirements, a Public <br />Hearing on this application must be conducted and all current <br />holders of Certificates of Public Convenience must be notified of <br />the Public Hearing. <br />Mr. Walter Jones was present and informed the Board that he <br />previously held a Certificate of Public Convenience to operate the <br />Allied Cab Company. For various reasons, Mr. Jones stated that he <br />left Indiana and moved to Florida. He has now returned to the <br />area and would like to begin operating a taxicab business again. <br />Mr. Jones stated that because of his prior involvement in the <br />business, he is aware of the licensing requirements. <br />Mr. Jones informed the Board that he intends to begin operating <br />with two (2) taxicabs and will provide twenty-four (24) hour <br />service.
