REGULAR MEETING <br />AUGUST 22, 1994 <br />least one (1) car on the street at all times. Mr. Woods further <br />stated that the City does not have any ordinances governing limo <br />services and if Mr. Schoby intends to operate this type of service <br />he does not need a license from the City. <br />Mr. Jones addressed the Board and advised that in response to Mr. <br />O'Connell's question regarding assets of the company, the total <br />assets at this time are $5,200.00 and the net worth is $300.00 <br />with more money being pumped -in to the business in the future. <br />Mr. Jones informed the Board that he has been operating in the <br />Roseland area from Notre Dame to the airport. In response to the <br />number of cabs he intends to operate, Mr. Jones stated that as <br />long as the Board has determined that there is no certain number <br />of cabs allowed, he would like the market to govern. <br />There being no further comments by individuals present, upon a <br />motion made by Mr. Leszczynski, seconded by Mrs. Manier and <br />carried, the Public Hearing on this matter was closed. <br />Mrs. Manier inquired of Mr. Jones if he would like to amend his <br />license application by adding the information he outlined <br />regarding his net worth and company name. Mr. Jones indicated <br />that he would like to amend his license. Therefore, Mr. Caldwell <br />made a motion that the license be amended as outlined. Mr. <br />Leszczynski seconded the motion which carried. <br />Board member Mrs. Manier asked Mr. Jones if he has been operating <br />a taxicab company. Mr. Jones stated that he has been operating <br />out of the County and also provides a courier service. He noted <br />that he is the private courier for the law firm of Barnes and <br />Thornburg in downtown South Bend. <br />Mrs. Manier also inquired of Mr. Jones if he was in any way <br />associated with the Allied Cab Company. Mr. Jones stated that he <br />gave up the Allied Cab Company in a judgement. The agreement was <br />that he would always be able to drive a cab with the company as <br />long as he signed over the Certificate. Since his return to South <br />Bend he has decided to secure a license of his own and not operate <br />a cab with the Allied Cab Company. <br />Mr. Jones stated that he did previously operate the Allied Cab <br />Company. That business was handed over to a Mr. Johnson and Mr. <br />Roger Woods handled the selling of the business to Mr. Johnson. <br />Mr. Woods informed the Board that Mr. Ed Johnson is a felon. <br />Mr. Caldwell made a motion that the Board deny renewal of the <br />license as there is already a Certificate with Mr. Jones' name on <br />it. The matter of this Certificate needs to be squared away <br />before the Board can look at issuing another Certificate. Until <br />that is taken care of, the Board cannot look at approving a new <br />business. <br />Mrs. Manier noted that there is nothing in the ordinance <br />precluding Mr. Jones from operating two (2) companies. However, <br />there is no record of Mr. Jones' action to transfer the <br />Certificate. <br />The motion to deny made by Mr. Caldwell died for lack of a second. <br />Board Attorney Mrs. Anne Bruneel inquired of Mr. Jones if he lost <br />the Certificate as part of a judgement. Mr. Jones stated that he <br />did. Mr. Jones further stated that as part of the agreement to <br />keep the case out of court, he had to sign over the Certificate <br />and then file the agreement with the judge. Mr. Jones and Mr. <br />Woods stated that the matter was finished and someone in the City <br />was notified. <br />
