282, <br />REGULAR MEETING MAY 23, 1994 <br />WHEREAS, Corporal Fred Eyster has agreed to care for "Rex" at <br />his ow expense and to keep him as a house pet and understands <br />that "sex" can never again be used as a Police Dog; and <br />WHEREAS, I.C. 36-1-11-6(c) permits and establishes a <br />procedure for disposal of property which is unfit for the purpose <br />for which it was intended and which is no longer needed by the <br />City. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works <br />of the City of South Bend, Indiana, that "Rex", a K-9 Police Dog, <br />is unf t for the purpose for which he was acquired, is no longer <br />of use to the City of South Bend, and has an estimated value of <br />less than One Thousand Dollars ($1,000.00). <br />BE IT FURTHER RESOLVED, that "Rex", the Police Dog, should be <br />retire and put into the care of Corporal Fred Eyster for use as a <br />house �et only. <br />this 23rd day of May, 1994. <br />CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS <br />s/John Leszczynski, President <br />s/James R. Parmerlee, Clerk <br />ADOPT AESOLUTION <br />NO. 20-1994 - APPROVING AN EXTENSION FOR REVIEW <br />FILED BY TCI OF MICHIANA <br />Mrs. Anne Bruneel submitted to the Board a <br />OF RATES <br />Board Attorney <br />Resolution <br />which approves an extension of time for the review of <br />the rates <br />filed by TCI of Michiana on April 25, 1994. Mrs. <br />Bruneel <br />noted that this Resolution invokes an additional ninety <br />(90) day <br />period of time in which to review TCI rates pursuant to <br />the FCC <br />regulations. Mr. Caldwell made a motion that the <br />Resolution <br />be adopted. Mr. Leszczynski seconded the motion which <br />carrie <br />and the following Resolution No. 20-1994 was adopted: <br />RESOLUTION NO. 20-1994 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />INVOKING AN ADDITIONAL NINETY DAYS <br />IN WHICH TO ISSUE A RATE ORDER <br />TO TCI OF MICHIANA, INC. <br />W <br />EREAS, the City of South Bend, Indiana, is certified with <br />the FC <br />to regulate rates for basic cable television service and <br />associ <br />ted equipment; and <br />WHEREAS, the Board of Public Works is vested with the <br />authority to administer the rate regulation process; and <br />WHEREAS, TCI of Michiana has filed with the Board of Public <br />Works its rates for basic cable television service and associated <br />equipment; and <br />W EREAS, FCC regulations and the South Bend Municipal Code <br />provide that a rate order be issued within thirty (30) days of the <br />filing of its rates by a cable operator; and <br />WH REAS, FCC regulations and the South Bend Municipal Code <br />additionally provide that the regulatory body may invoke an <br />additional ninety (90) days to ensure that the operator's rates <br />
