288 <br />MEETING <br />MAY 23, 1994 <br />are within the FCC's reasonable rate standard; and <br />WHEREAS, the Board of Public Works wishes to avail itself of <br />this extended review period. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works <br />of the City of South Bend, Indiana, as follows: <br />The rate review period is extended an additional ninety (90) <br />da s. <br />Adopted this 23rd day of May, 1994. <br />SOUTH BEND BOARD OF PUBLIC WORKS <br />s/John E. Parmerlee, Clerk <br />ADOPT RESOLUTION NO. 21-1994 - RECOMMENDING APPROVAL OF A SCRAP <br />METAL/JUNK DEALERS/TRANSFER STATION LICENSE - SOUTH BEND AUTO <br />PARTS <br />Mr. Leszczynski advised that the Board is in receipt of Resolution <br />No 21-1994 recommending to the Common Council the approval of a <br />license application for a Scrap Metal Dealer/Recycling Operation, <br />as submitted by Mr. Steven C. Cupery, 25858 North Park Avenue, <br />Elkhart, Indiana, to operate a scrap yard/recycling operation at <br />3077 West Calvert Street, South Bend, Indiana. Mr. Leszczynski <br />noted that the Department of Code Enforcement and the Fire <br />Department have inspected the property and recommend approval. <br />Mr. Roger Baele, 1719 South Taylor, South Bend, Indiana, <br />representing the Rum Village Neighborhood Association, was present <br />and informed the Board that this type of operation was <br />"g andfathered" for this location. Mr. Bailey noted that when <br />this operation was previously in business, the neighborhood <br />experienced a lot of traffic with traffic stopping on Calvert <br />Street. He stated that should this operation be permitted, they <br />would request that the Health Department be asked to make an <br />inspection of the property, as well as the EPA, because the <br />re idents are concerned about the water supply in the area because <br />of this business. <br />Mr. Caldwell inquired of Board Attorney Anne Bruneel what options <br />thE Board has in this matter. Mrs. Bruneel informed the Board <br />that the Resolution submitted to the Board today merely submits to <br />thE Common Council a recommendation on this matter. The <br />inspections, pursuant to the licensing ordinance, have been <br />pe formed and the applicant is in compliance with ordinance <br />requirements. The Board can refer the matter to the Common <br />Council with a positive or negative recommendation or no <br />recommendation at all. The final decision on this application is <br />in the hands of the Common Council who will conduct a Public <br />Hearing to determine whether or not to grant the license. <br />Mr. Caldwell stated that as much as he regrets the decision, the <br />Board has no choice but to send this application to the Common <br />Council with a favorable recommendation. Mr. Caldwell advised Mr. <br />Ba le that he would urge the neighborhood association to attend <br />thE Common Council meeting when it is on their agenda for final <br />approval. Mr. Caldwell further stated that he realizes that the <br />neighborhood association has worked long and hard in upgrading the <br />neighborhood. <br />Th�refore, Mr. Caldwell made a motion that the Resolution which <br />ha been submitted be adopted.
