139 <br />REGULAR MEETING <br />MARCH 21, 1994 <br />Football Hall of Fame Construction Manager Agreement with Verkler <br />Construction Management Services, 645 North Wilber Street, P.O. <br />Box 3608, South Bend, Indiana. Mrs. Shidler noted that the City <br />is now in the second and final phase of the original contract with <br />Verkler Construction as construction manager. Phase one of this <br />project was entered into initially and now it is time for the <br />second phase of services which is the construction phase. <br />Addendum No. 2 indicates that the scope of services to be provided <br />by the Construction Manager shall be limited to Construction Phase <br />Services for a lump sum management fee of one hundred thirty-one <br />thousand dollars ($131,000.00) and a Construction Services Fee not <br />to exceed reimbursables of two hundred ninety-seven thousand four <br />hundred dollars ($297,400.00). The obligations of the City are <br />subject to the issuance and sale of bonds. Mr. Caldwell made a <br />motion that this Addendum No. 2 be approved and executed. Mrs. <br />Manier seconded the motion which carried. <br />APPROVE COMMUNITY DEVELOPMENT ADDENDUM <br />Mr. Leszczynski advised that the following Community Development <br />Addendum was presented to the Board for approval: <br />ADDENDUM I <br />SOUTH BEND POLICE DEPARTMENT <br />NEIGHBORHOOD WATCH ACTIVITY <br />Addendum I extends the Contract through February 28, 1994. <br />Ms. Marcia Townsend, Department of Community and Economic <br />Development, stated that this extension allows the agency to <br />finish spending funds allocated. Ms. Townsend noted that the <br />funds were obligated in January. <br />Therefore, Mr. Caldwell made a motion that this Addendum be <br />approved and executed. Mrs. Manier seconded the motion which <br />carried. <br />FAVORABLE RECOMMENDATION - VACATION OF TUTT STREET, FROM MAIN TO <br />1ST N/S ALLEY W. OF MICHIGAN STREET AND 1ST N/S ALLEY E. OF MAIN <br />STREET FROM TUTT TO THE SOUTH TO THE 1ST E/W ALLEY N. OF TUTT TO <br />THE NORTH <br />Mr. Leszczynski indicated that the Common Council has submitted to <br />the Board a Vacation Petition as completed by Ms. Ann E. Kolata, <br />Redevelopment Director, City of South Bend Department of Community <br />and Economic Development and Mr. Stanley J. Blenke, Executive <br />Vice -President, Schafer Gear Works, Inc., to vacate the following <br />property: <br />Tutt Street, from Main Street to the first north/south alley <br />west of Michigan Street, <br />and <br />The first north/south alley east of Main Street from Tutt <br />Street, to the south to the first east/west alley north of Tutt <br />Street, to the north <br />Mrs. Ann Kolata, Redevelopment Director, Department of Community <br />and Economic Development was present and informed the Board that <br />there has been a slight modification to the legal description of <br />this vacation petition and a substitute ordinance has been <br />submitted to the Common Council. Originally, the petition <br />indicated the vacation of Tutt Street, from Main Street to the <br />first north/south alley east of Main Street. That legal <br />description has been corrected as follows: <br />Tutt Street, from Main Street to the first north/south alley <br />west of Michigan Street. <br />
