461 <br />REGULAR MEETING <br />OCTOBER 28, 1996 <br />Mr. Leszczynski advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, <br />Department of Economic Development and the Department of Public Works. Therefore, Mr. <br />Caldwell made a motion that the Board send a favorable recommendation to the Common Council <br />concerning this Vacation Petition, subject to any utility easements that may be required. Mr. <br />Leszczynski seconded the motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE A STREET <br />Mr. Leszczynski indicated that the Common Council has submitted to the Board a Vacation Petition <br />as completed by Mr. William Faust, 312 North Hill Street, Mishawaka, Indiana to vacate the <br />following street: <br />O'Brien Street between Washington and Orange Streets <br />Mr. Leszczynski advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, <br />Department of Economic Development and the Department of Public Works. Therefore, Mr. <br />Caldwell made a motion that the Board send a favorable recommendation to the Common Council <br />concerning this Vacation Petition, subject to any utility easement that may be required. Mr. <br />Leszczynski seconded the motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY <br />Mr. Leszczynski indicated that the Common Council has submitted to the Board a Vacation Petition <br />as completed by Mr. William Panzica, Western Avenue Properties, 422 East Monroe, South Bend, <br />Indiana to vacate the following alley: <br />The alley to be vacated is described as the first north/south alley west of St. Joseph Street <br />from the south right-of-way of West Western to the north right-of-way of the first east/west <br />alley south of West Western Avenue for a distance of approximately 198 feet in length and <br />width of 14 feet. Part located in Martin's Addition in the City of South Bend, Indiana. <br />Mr. Leszczynski advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, <br />Department of Economic Development and the Department of Public Works. Therefore, Mr. <br />Caldwell made a motion that the Board send a favorable recommendation to the Common Council <br />concerning this Vacation Petition, subject to any utility easements and turning easement that may be <br />required. Mr. Leszczynski seconded the motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE A STREET <br />Mr. Leszczynski indicated that the Common Council has submitted to the Board a Vacation Petition <br />as completed by Lang, Feeney and Associates, 715 South Michigan Street, South Bend, Indiana to <br />vacate the following street: <br />Sampson Street running north from the north right-of-way line of east Ireland Road for a <br />distance of approximately 617 feet and a width of 50 feet. Part located in the west half, <br />northeast quarter, section 30, Township 37 north, Range 3 east, City of South Bend, St. <br />Joseph County, Indiana. <br />Mr. Leszczynski advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, <br />Department of Economic Development and the Department of Public Works. Area Plan Commission <br />stated that the right-of-way be vacated, only if access_ to the property to the north is provided and <br />subject to any utility easements that may be required. Therefore, Mr. Caldwell made a motion that <br />the Board send a favorable recommendation to the Common Council concerning this Vacation <br />Petition.
