<br />consideration for permission to tap into the public sanitary sewer system of the City, to provide
<br />sanitary sewer service to Lots 35 Greenleaf 2nd Addition Section `B", South Bend, Indiana, (Key
<br /># 02-1206-0317-04), the Pearson's waive and release any and all right to remonstrate against or
<br />oppose any pending or future annexation of the property by the City of South Bend. Therefore, Mr.
<br />Caldwell made a motion that the Consent be approved. Mr. Leszczynski seconded the motion which
<br />carried.
<br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE
<br />Mr. Leszczynski stated that the Board is in receipt of a Consent to Annexation and Waiver of Right
<br />to Remonstrate as submitted by Mr. John Bennett. The Consent indicates that in consideration for
<br />permission to tap into the public sanitary sewer system of the City, to provide sanitary sewer service
<br />to Lot 97 Vogt's Edison Road, 5th Addition, South Bend, Indiana, (Key # 17-1079-2865), Mr.
<br />Bennett waives and releases any and all right to remonstrate against or oppose any pending or future
<br />annexation of the property by the City of South Bend. Therefore, Mr. Caldwell made a motion that
<br />the Consent be approved. Mr. Leszczynski seconded the motion which carried.

<br />Christie waives and releases any and all right to remonstrate against or oppose any pending or future
<br />annexation of the property by the City of South Bend. Therefore, Mr. Caldwell made a motion that
<br />the Consent be approved. Mr. Leszczynski seconded the motion which carried.

<br />consideration for permission to tap into the public sanitary sewer system of the City, to provide
<br />sanitary sewer service to Lot 1, Plat ofRitters Dixie Gardens, South Bend, Indiana, (Key # 01-1017-
<br />034401), the Harris's waive and release any and all right to remonstrate against or oppose any
<br />pending or future annexation of the property by the City of South Bend. Therefore, Mr. Caldwell
<br />made a motion that the Consent be approved. Mr. Leszczynski seconded the motion which carried.
<br />APPROVAL OF RECOMMENDATION - TO CONDUCT RILEY HIGH SCHOOL "MARCH-A-
<br />THON"
<br />Mr. Leszczynski stated that favorable recommendations have been received by the Division of
<br />Engineering, Park Department, Police Department and the City Attorney's office, in reference to a
<br />request as submitted by Ms. Melissa Burton, Riley High School, 405 East Ewing, South Bend,
<br />Indiana to conduct the above referred to march, on Saturday, November 2, 1996, from 9:00 a.m. until
<br />1:00 p.m., on the designated route as submitted. Upon a motion made by Mr. Caldwell, seconded
<br />by Mr. Leszczynski and carried the recommendation was approved.
<br />FAVORABLE RECOMMENDATION - PETITION TO VACATE VARIOUS ALLEYS
<br />Mr. Leszczynski indicated that the Common Council has submitted to the Board a Vacation Petition
<br />as completed by Mr. Angelo Ciao, 2511 West Ewing, South Bend, Indiana to vacate the following
<br />alleys:
<br />The first north/south alley west of Wabash Street from the north right-of-way of West Ewing
<br />Avenue to the South right-of-way of the first east/west alley north of West Ewing Avenue
<br />running between Meade and Wabash Streets, for a distance of approximately 120 feet in
<br />length and a width of 14 feet, part located in Homeland 2nd Addition to the City of South
<br />Bend, Indiana.
<br />Also, the first east/west alley north of West Ewing Avenue from the west right-of-way of
<br />Wabash Street to the east right-of-way of the first north/south alley west of Wabash Street
<br />for a distance of approximately 129 feet in length and a width of 14 feet, part located in
<br />Homeland 2nd Addition to the City of South Bend, Indiana.
