REGULAR MEETING OCTOBER 14, 1996 <br />and no longer useful to the City of South Bend; and <br />WHEREAS, SERGEANT MICHAEL X MARTMCZAK has retired from the South Bend <br />Police Department after twenty-one (21) years of service and the Board of Public Safety of the City <br />of South Bend has determined that he has retired in good standing; and <br />WHEREAS, I.C. 36-1-11-6 permits and establishes procedure for disposal of personal <br />property which is no longer needed by the City and which is unfit for the purpose for which it was <br />intended; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South <br />Bend that sidearm Serial No. AD18938, a .40 caliber Sig -Sauer sidearm, is no longer needed by the <br />City and is unfit for the purpose for which it was intended and has an estimated fair market value of <br />less than Five Hundred Dollars ($500.00). <br />BE IT FURTHER RESOLVED that said property be disposed of and removed from the City <br />inventory. <br />ADOPTED this 14th day of October, 1996. <br />BOARD OF PUBLIC WORKS <br />s/John E. Jacob, Clerk <br />APPROVAL OF REPORT OF CONTRACT FINAL INSPECTION AND RECOMMENDATION <br />FOR ACCEPTANCE - IRONWOOD WIDENING - PROJECT NO. 96-25 <br />Mr. Leszczynski stated that Mr. Toy Villa, Engineer, has submitted a Report of Contract Final <br />Inspection and Recommendation for Acceptance for the above referred to project. Mr. Villa stated <br />that this report states that the project has been final inspected, and the contractor may request from <br />the Indiana Department of Transportation a reduction in their retainage. Upon a motion made by Mr. <br />Caldwell, seconded by Mrs. Manier and carried, the Report was approved. <br />APPROVAL OF RECOMMENDATION TO ENCROACH ONTO PUBLIC RIGHT-OF-WAY - <br />SIGN INSTALLATION - 2525 SOUTH MICHIGAN - NEW LIFE DELIVERANCE CENTER <br />Mr. Leszczynski advised that the Board is in receipt of favorable recommendations from the Division <br />of Engineering, Police Department, Building Commissioner and the Redevelopment Design Review <br />Committee for the installation of a sign at 2525 South Michigan, South Bend, Indiana, subject to an <br />Indemnification and Hold Harmless Undertaking. Further, it is to be noted that the sign installation <br />is subject to the removal of the sign in the event the City, at some point in time would require the <br />right-of-way. Upon a motion made by Mrs. Manier, seconded by Mrs. Caldwell and carried, the <br />recommendation was approved. <br />APPROVAL OF RECOMMENDATION TO ENCROACH ONTO PUBLIC RIGHT-OF-WAY - <br />AWNING INSTALLATION - 105 EAST JEFFERSON - PEABODY CAFE <br />Mr. Leszczynski advised that the Board is in receipt of favorable recommendations from the Division <br />of Engineering, Police Department, Building Commissioner and the Redevelopment Design Review <br />Committee for the installation of an awning at 105 East Jefferson, South Bend, Indiana, subject to <br />an Indemnification and Hold Harmless Undertaking. Upon a motion made by Mrs. Manier, seconded <br />by Mr. Caldwell and carried, the recommendation was approved. <br />APPROVAL OF RECOMMENDATION - APPROVAL OF SIDEWALK CAFE - 105 EAST <br />JEFFERSON - PEABODY CAFE <br />Mr. Leszczynski stated that favorable recommendations have been received by the Division of <br />Engineering, Building Department, Design Review Committee, Police Department and the City <br />Attorney's office, in reference to a request as submitted by Mr. Edward Gillooly, 104 U.S. 12 West, <br />
