`1 , <br />REGULAR MEETING JULY 29. 1996 <br />APPROVE PROJECT COMPLETION AFFIDAVIT - COLLEGE FOOTBALL HALL OF FAME - <br />GENERAL CONSTRUCTION - HUNTER CORPORATION - PROJECT NO 93-09 <br />Mr. Caldwell advised that Mr. Bob Allen, Public Construction Manager, has submitted the Project <br />Completion Affidavit on behalf of Hunter Corporation, 6000 Southport Road, Portage, Indiana, for <br />the above referred to project, indicating a final cost of $610,977.67. Upon a motion made by Mrs. <br />Manier, seconded by Mr. Caldwell and carried, the Project Completion Affidavit was approved. <br />APPROVAL OF REQUEST TO ADVERTISE FOR THE RECEIPT OF BIDS - ONE (1) MORE <br />OR LESS DISC TYPE CHIPPER <br />In a memorandum to the Board, Mr. Matthew Chlebowski, Director, Division of Equipment <br />Services, requested permission to advertise for the receipt of bids for the above referred to item. Mr. <br />Chlebowski stated that the wood chipper is for use by the Sewer Department, and funding will be <br />provided by the User Department Capital Fund. Therefore, upon a motion made by Mr. Caldwell, <br />seconded by Mrs. Manier and carried, the request to advertise for the receipt of bids was approved. <br />ADOPT RESOLUTION NO. 52-1996 - DISPOSAL OF CITY -OWNED PROPERTY <br />Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 52-1996 <br />WHEREAS, I.C. 36-9-6-1 gives the Board of Public Works of the City of South Bend the <br />right and duty to have custody of, control of, use of, and dispose of in accordance with Indiana <br />statutes, all real and personal property owned by the City of South Bend; and <br />WHEREAS, the Common Council of the City of South Bend passed as amended on January <br />9, 1995, Ordinance No. 8570-95 which states that upon retirement with twenty (20) or more years <br />of service: <br />"Upon retirement with twenty (20) or more years of service to the City of South Bend, <br />Indiana, a sworn member of the South Bend Fire Department shall be entitled to retain as his <br />or her own personal property, the fire helmet used by such Firefighter immediately prior to <br />giving notice of his or her retirement." <br />and <br />WHEREAS, John M. Becker and Leonard R. Klosinski have retired from the South Bend, <br />Indiana Fire Department after twenty (20) or more years of service, and the Board of Public Safety <br />of the City of South Bend, Indiana has determined that they have retired in good standing; and <br />WHEREAS, I.C.. 36-1-11-6 permits and established procedure for disposal of personal <br />property which is no longer needed by the City and which is unfit for the purpose for which it was <br />intended; and <br />WHEREAS, Chief Luther Taylor has advised that the fire helmets previously worn by these <br />Firefighters are of no further use to the Department and of no practical value; <br />NOW, THEREFORE, BE IT RESOLVED, by the Board of Public Works of the City of <br />South Bend that the fire helmets worn by these Firefighters are no longer needed by the City and <br />unfit for the purpose for which they were intended and have an estimated fair market value of less <br />than One Thousand ($1,000.00) Dollars. <br />BE IT FURTHER RESOLVED that said property be disposed of in accordance with <br />Ordinance 8570-95 and removed from the City inventory. <br />Adopted this 29th day of July, 1996. <br />BOARD OF PUBLIC WORKS <br />
