M <br />REGULAR MEETING <br />FEBRUARY 26, 1996 <br />WHEREAS, an insurance settlement for the loss incurred by the City due to the destruction <br />of the above -referenced vehicle has been reached by the City and the State Farm Insurance <br />Company, which settlement includes payment to the City of $16,750.00 upon receipt of the vehicle <br />and title to the vehicle; and <br />WHEREAS, release of the title to the above -referenced vehicle to State Farm Insurance <br />Company is a necessary condition of said settlement. <br />NOW, THEREFORE, BE IT RESOLVED, by the Board of Public Works of the City of <br />South Bend as follows: <br />1. That the above referenced vehicle has been destroyed as the result of an accident, is <br />no longer needed by the City, is unfit for the purpose for which it was intended. <br />2. That title to said vehicle shall be released and the vehicle transferred to the State <br />Farm Insurance Company as part of the insurance settlement reached with respect to <br />said vehicle. <br />3. This Resolution shall be effective upon adoption by the Board of Public Works of the <br />City of South Bend. <br />Adopted this 26th day of February, 1996. <br />BOARD OF PUBLIC WORKS <br />s\James R. Jacob, Clerk <br />ADOPT RESOLUTION NO. 14-1996 - DISPOSAL OF CITY -OWNED PROPERTY <br />Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 14-1996 <br />WHEREAS, I.C. 36-9-6-1 gives the Board of Public Works of the City of South Bend the <br />right and duty to have custody of, control of, use of, and dispose of in accordance with Indiana <br />statutes, all real and personal property owned by the City of South Bend; and <br />WHEREAS, the Common Council of the City of South Bend passed as amended on January <br />9, 1995, Ordinance No. 8570-95 which states that upon retirement with twenty (20) or more years <br />of service: <br />"Upon retirement with twenty (20) or more years of service to the City of South Bend, <br />Indiana, a sworn member of the South Bend Fire Department shall be entitled to retain as his <br />or her own personal property, the fire helmet used by such Firefighter immediately prior to <br />giving notice of his or her retirement." <br />and <br />WHEREAS, Robert L. Snider, Martin J. Orlowski, Thomas J. Bajdek, Alvin J. <br />Wroblewski, Edwin J. Kaczmarek and Gordon P. Martinczak have retired from the South Bend, <br />Indiana Fire Department after twenty (20) or more years of service, and the Board of Public Safety <br />of the City of South Bend, Indiana has determined that they have retired in good standing; and <br />
