341 <br />REGULAR MEETING AUGUST 11, 1997 <br />APPROVAL OF RECOMMENDATION - TO CONDUCT BLOCK PARTY <br />Mr. Caldwell stated that favorable recommendations have been received by the Division of <br />Engineering, Police Department and the City Attorney's office, in reference to a request as submitted <br />by Mr. Rick Clifford, 722 Cottage Grove, South Bend, Indiana to conduct the above referred to <br />block party, on Saturday, September 13, 1997, from 10:00 a.m. until 10:00 p.m., on Cottage Grove <br />from Lindsey to Van Buren. Upon a motion made by Mr. Littrell, seconded by Mr. Caldwell and <br />carried, the recommendation was approved. <br />APPROVAL OF RECOMMENDATION - TO CONDUCT YOUTH FESTIVAL - MACEDONIA <br />M.B. CHURCH <br />Mr. Caldwell stated that favorable recommendations have been received by the Division of <br />Engineering, Police Department and the City Attomey's office, in reference to a request as submitted <br />by Reverend Anthony Pethis, Macedonia M.B. Church, 1862 North Olive, South Bend, Indiana to <br />conduct the above referred to youth festival, on Saturday, August 16, 1997, from 9:00 a.m. until 4:00 <br />p.m., on Fremont from Hamilton to Marquette. Upon a motion made by Mr. Caldwell, seconded by <br />Mr. Littrell and carried, the recommendation was approved. <br />APPROVAL OF RECOMMENDATION - TO_ CONDUCT ST. PAUL BETHEL CHURCH <br />DEDICATION SERVICE <br />Mr. Caldwell stated that favorable recommendations have been received by the Division of <br />Engineering, Police Department and the City Attorney's office, in reference to a request as submitted <br />by Mr. Curtis Kirkendoll, St. Paul Bethel Church, 621 Lindsey Street, South Bend, Indiana to <br />conduct the above referred to dedication service, on Saturday, August 16, 1997, from 4:00 p.m. until <br />5:00 p.m. on Lindsey Street from Pierce to Scott Street. Upon a motion made by Mr. Caldwell, <br />seconded by Mr. Littrell and carried, the recommendation was approved. <br />APPROVAL OF RECOMMENDATION - TO CONDUCT INTERSECTION SOLICITATION - <br />MUSCULAR DYSTROPHY ASSOCIATION <br />Mr. Caldwell stated that favorable recommendations have been received by the Division of <br />Engineering, Police Department and the City Attorney's office, in reference to a request as submitted <br />by Ms. Stephanie Santos, Muscular Dystrophy Association, 112 North Main Street, Mishawaka, <br />Indiana to conduct the above referred to intersection solicitation, on Sunday, August 17, 1997 from <br />11:00 a.m. until 3:00 p.m., at the intersections of Miami and Ironwood Roads; Lombardy and <br />Western; and Lincolnway East and Twyckenham. Upon a motion made by Mr. Caldwell, seconded <br />by Mr. Littrell and carried, the recommendation was approved. <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE A STREET <br />Mr. Caldwell indicated that the Common Council has submitted to the Board a Vacation Petition as <br />completed by Mr. Stanley Kollier, 1420 Medora Street, South Bend, Indiana to vacate the following <br />street: <br />King Street from the east right-of-way of Medora Street east to the west line of the first <br />north -south alley east of Medora Street for a distance of approximately 116.43 feet and a <br />width of 60 feet. Part located in Austin Park Addition, Portage Township, City of South <br />Bend, Indiana. <br />Mr. Caldwell advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Police Department and the Fire Department. Area Plan has stated that <br />the request does not meed at least one of the standards for vacation, that "the vacation would not <br />hinder the use of a public way by the neighborhood in which it is located or to which it is <br />contiguous". The vacation would result in the creation of a dead end street which does appear to be <br />used by the surrounding residents. Area Plan recommends that no dead end streets or alleys be <br />created unless sufficient space exists for vehicles to turn around or an easement is provided to allow <br />vehicles to exit without having to back out. While exiting to the north along the alley is possible, it <br />is not the best option. In addition, the vacation of King Street would hinder the provision of City <br />services by limiting access of police and fire vehicles, postal vehicles, and snow plows. Although it <br />does not affect the legality of the petition, Area Plan believes it is important to note that only one of <br />the property owners on King Street, between Medora and Anderson has signed the petition to vacate. <br />Therefore, Area Plan recommends that the request be denied.
