Therefore, Mr. Caldwell made <br />a motion that the Board send an unfavorable recommendation to the Common Council concerning <br />this Vacation Petition. Mr. Littrell seconded the motion which carried. <br />TABLE REQUEST FOR LICENSE APPLICATION - SECOND HAND DEALER <br />Mr. Caldwell stated that the following secondhand dealers license application has been received: <br />NAME: Ellis Furniture <br />BY: Robert V. Ellis <br />ADDRESS: 803-807 Lincolnway <br />FOR THE PURPOSE OF SELLING: Not listed on application <br />Mr. Caldwell further advised that favorable recommendations have been received from the Bureau <br />of Traffic and Lighting, Police Department and Fire Department concerning the above application. <br />However, the Department of Code Enforcement has stated that the business appears to be closed. <br />Upon a motion made by Mr. Caldwell, seconded by Mr. Littrell and carried, the above license <br />application was tabled. <br />DENY REOUEST - TO INSTALL BANNER POLES IN RIGHT-OF-WAY <br />Mr. Caldwell stated that favorable recommendations have been received by Design Review and the <br />Police Department, in reference to a request as submitted by Mr. John Phair, The Holladay Group, <br />220 West Colfax, South Bend, Indiana to install banner poles at the property at 3300 West Sample <br />Street, South Bend, Indiana. However, the Division of Engineering stated that no advertisement may <br />be placed in the public right-of-way. Upon a motion made by Mr. Caldwell, seconded by Mr. Littrell <br />and carried, the request was denied. <br />DENY REQUEST FOR LICENSE APPLICATION FOR RUBBISH AND GARBAGE REMOVAL <br />SERVICE <br />Mr. Caldwell stated that the Board is in receipt of an unfavorable recommendation from the <br />Department of Code Enforcement for a License Application for a Rubbish and Garbage Removal <br />Service, as submitted by Mr. Douglas Guest, 225 South Logan, South Bend, Indiana. The <br />Department of Code Enforcement has inspected the premises several times, and has stated that Mr. <br />Guest takes a full trash truck home, and dumps the debris in the retention basin behind his home. <br />There have been numerous problems with trash hauling around the City of South Bend. Upon a <br />motion made by Mr. Caldwell, seconded by Mr. Littrell and carried, the License Application was <br />denied. <br />DENY REQUEST FOR LICENSE APPLICATION FOR RUBBISH AND GARBAGE REMOVAL <br />SERVICE <br />Mr. Caldwell stated that the Board is in receipt of an unfavorable recommendation from the <br />Department of Code Enforcement for a License Application for a Rubbish and Garbage Removal <br />Service, as submitted by Mr. Eddy Curry, 1808 South Scott, South Bend, Indiana. The Department <br />of Code Enforcement has inspected the premises several times, and has stated that Mr. Curry parks <br />a full trash truck in a residential area, and has no valid driver's license. Upon a motion made by Mr. <br />Caldwell, seconded by Mr. Littrell and carried, the License Application was denied. <br />APPROVAL OF REQUEST TO CONDUCT PUBLIC AUCTION <br />In a letter to the Board, Mr. Matthew Chlebowski, Director, Equipment Services, requested <br />permission to conduct a public auction on Saturday, September 13, 1997, at 1045 West Sample <br />Street, to dispose of obsolete equipment. Therefore, upon a motion made by Mr. Caldwell, seconded <br />by Mr. Littrell and carried, the request to conduct a public auction was approved. <br />APPROVAL OF WAIVER OF RIGHT TO APPEAL <br />Upon a motion made by Mr. Caldwell, seconded by Mr. Littrell and carried, a Waiver of Right to <br />Appeal was approved, in the decision of the Plat Committee to the Area Plan Commission within ten <br />(10) days of the Notice of the committees' action, to waive the right to appeal for the purpose of <br />expediting the process for secondary approval, after the decision made by the Plat Committee on <br />primary approval of the American Homes Dreams Replat. <br />1 <br />1 <br />
