REGULAR MEETING MARCH 3, 1997 Bureau of Housing $300,00 Affordable Loan, Repair Grant and Good Neighbors Programs, 1997 Upon a motion made by Mr. Littrell, seconded by Mr. Caldwell and carried, the above referred to Contracts and Addendum were approved and executed. APPROVAL OF LEASE AGREEMENT - FRATERNAL ORDER OF POLICE LODGE NO. 36 Mr. Caldwell stated that the Board is in receipt of a Lease Agreement between the City of South Bend and the Fraternal Order of Police Lodge No. 36, for property at 25327 State Road 23, South Bend, Indiana, and 1530 South Main Street, South Bend, Indiana. Mr. Caldwell noted that the Agreement is in the amount of $20,000.00 from February 1, 1996 to January 31, 1997. Therefore, upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the Agreement was approved and executed. APPROVAL OF MANAGEMENT AGREEMENT - STUDEBAKER NATIONAL MUSEUM INC. Mr. Caldwell stated that the Board is in receipt of an Agreement between the City of South Bend and the Studebaker National Museum, Inc., for management services for the Studebaker National Museum. Mr. Caldwell noted that the Agreement is in the amount of $125,262.00 annually. Therefore, upon a motion made by Mr. Littrell, seconded by Mr. Caldwell and carried, the Agreement was approved and executed. ADOPT RESOLUTION NO. 11-1997 - DISCLAIMING ANY INTEREST IN A CERTAIN PARCEL OF REAL ESTATE COMMONLY KNOWN AS 1016 NORTH OLIVE STREET SOUTH BEND, INDIANA Upon a motion made by Mr. Caldwell, seconded by Mr. Littrell and carried, the following Resolution was adopted by the Board of Public Works: RESOLUTION NO. 11-1997 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, DISCLAIMING ANY INTEREST IN A CERTAIN PARCEL OF REAL ESTATE COMMONLY KNOWN AS 1016 NORTH OLIVE STREET, SOUTH BEND, INDIANA WHEREAS, the Board of Public Works ('Board") has custody of all real property owned by the City of South Bend; and WHEREAS, a quit -claim deed has been received in the Office of the Recorder which purports to transfer the following described parcel of real property: Key number: 18 2091 3405 Lot 30 Plat Mayes Mich Avenue Addition, and commonly described as 1016 North Olive Street, to the City of South Bend; and WHEREAS, said quit -claim deed was executed by Jay Read, prepared and .notarized by Carol McIntyre, and recorded with the Office of the Recorder of St. Joseph County, Indiana, on November 15, 1996; and WHEREAS, the Department of Code Enforcement ordered that the structure on the above mentioned parcel be demolished, said order was affirmed by the St. Joseph County Circuit Court in Cause No. 71C01-9508-CP-00873, and is currently pending before the Indiana Court of Appeals in Cause No. 71A03-9609-CV-002-00352, Jay Read and Carol McIntyre v. City of South Bend; and 1
