REGULAR MEETING MARCH 3, 1997 <br />WHEREAS, on January 6, 1997, Jay Read and Carol McIntyre submitted to the Court of <br />Appeals the affidavit of Carol McIntyre, stating under oath, "Technically, Mr. Read is the title owner <br />and I was utilized as a manager of that property [ 1016 North Olive Street] for Mr. Read," without <br />mentioning the quit -claim deed executed by Jay Read and prepared and notarized by Carol McIntyre; <br />and <br />WHEREAS, neither the Board of Public Works nor any person acting on behalf of the City <br />of South Bend has accepted or intends to accept transfer of a deed to the above mentioned parcel; <br />and <br />WHEREAS, the attempt to transfer the above mentioned parcel and the execution and <br />recording of the above mentioned quit -claim deed were done without the knowledge or consent of <br />the Board of Public Works or of any person acting on behalf of the City of South Bend; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />Section I. That the Board of Public Works hereby disclaims any interest, legal or equitable, <br />in the following described parcel of real property: <br />Key number: 18 2091 3405 <br />Lot 30 Plat Mayr's Mich Avenue Addition, <br />and commonly described as 1016 North Olive Street. <br />Section II. The Clerk of the Board is instructed to give notice of the adoption of this <br />resolution to the Office of the Recorder and the Office of the Treasurer for St. Joseph County, <br />Indiana immediately upon its execution, and to take any and all other necessary and proper actions <br />to effectuate this disclaimer. <br />Adopted on the 3rd day of March, 1997, by the Board of Public Works of the City of South <br />Bend, Indiana. <br />BOARD OF PUBLIC WORKS OF THE <br />CITY OF SOUTH BEND, INDIANA <br />s/James R. Jacob, Clerk <br />ADOPT RESOLUTION NO. 12-1997 - DISPOSAL OF CITY -OWNED PROPERTY <br />Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the following Resolution <br />was adopted by the Board of Public Works: <br />RESOLUTION NO. 12-1997 <br />WHEREAS, I.C. 36-9-6-1 gives the Board of Public Works of the City of South Bend the <br />right and duty to have custody of, control of, use of, and dispose of in accordance with Indiana <br />statutes, all real and personal property owned by the City of South Bend; and <br />WHEREAS, the Common Council of the City of South Bend passed as amended on January <br />11, 1988, Ordinance No. 7847-88 which mandates the Board of Public Works of the City of South <br />Bend to determine that the sidearm of a police officer who retires in good standing is surplus property <br />and no longer useful to the City of South Bend; and <br />
