<br />A RESOLUTION OF THE THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH
<br />BEND, INDIANA, DECLARING ITS INTENT TO LEASE OFFICE SPACE AT 205 WEST
<br />JEFFERSON BOULEVARD, SUITE 100, SOUTH BEND, INDIANA
<br />WHEREAS, the City of South Bend requires office space for the City of South Bend/St.
<br />Joseph County Building Department; and
<br />WHEREAS, the property at 205 west Jefferson Blvd., Suite 100, South Bend, Indiana, has
<br />been selected as a site for general office space; and
<br />WHEREAS, the property to be leased contains approximately four thousand one hundred
<br />eleven (4,111) square feet, an area sufficient to accommodate the Building Department; and
<br />WHEREAS, the Board of Public Works of the City of South Bend, Indiana, on November
<br />23, 1998, received a petition ("Petition") signed by at least fifty taxpayers of the City of South Bend,
<br />requesting that the Board lease the premises at 205 Wes Jefferson Blvd.,1 st Floor, Suite 100, South
<br />Bend, Indiana, for a term of one year, with rent not to exceed Forty -Five Thousand Two Hundred
<br />TwentyOne Dollars and Four Center ($45,221.04), with a one year option to renew exercisable at
<br />the City's option at the same rental rate; and
<br />WHEREAS, the Board also received, on November 23, 1998, a certificate of the St. Joseph
<br />County Auditor, certifying that the verifier of the Petition and at least fifty signers of the Petition are
<br />taxpayers of property within the corporate limits of the City of South Bend; and
<br />WHEREAS, the Board also received, on November 23, 1998, a proposed lease agreement;
<br />and
<br />WHEREAS, I.C. 36-1-10-7 (2) requires that prior to the Board's entering into a lease
<br />agreement, the South Bend Common Council must determine, after investigation, that the lease is
<br />needed.
<br />NOW, IT IS RESOLVED as follows:
<br />1) The Board of Public Works of the City of South Bend, Indiana, seeks to lease the premises
<br />at 205 West Jefferson Boulevard, 1st floor, Suite 100, South Bend, Indiana, for use as general office
<br />space.
<br />2) The petition certified by the St. Joseph County Auditor and submitted to the Board on
<br />November 23, 1998, is accepted for filing and made available for public inspection.
<br />3) The lease shall be for a term of one year, with rent not to exceed Forty -Five Thousand Two
<br />Hundred Twenty -One Dollars and Four Cents ($45,221.04), with a one hear option to renew
<br />exercisable at the City's option at the same rental rate; and
<br />4) 1 st Source Bank is entitled to a tax exemption for the leased portion of the premises
<br />pursuant to I.C. 36-1-10.
<br />5) The Proposed Lease for the premises submitted to the Board on November 23, 1998, is
<br />accepted for filing and made available for public inspection.
<br />6) The Board authorizes a Resolution to be filed with the City Clerk for consideration by the
<br />Common Council of the City of South Bend, Indiana, to establish its determination that the lease is
<br />needed.
<br />7) A public hearing on the proposed lease is hereby set for December 21, 1998, at 9:30 a.m.

<br />at which all persons will be given the opportunity to address whether the Proposed Lease is necessary
