APPROVE CHANGE ORDER NO. 2 (FINAL) AND PROJECT COMPLETION AFFIDAVIT -
<br />SAMPLE EWING REDEVELOPMENT AREA - SITE CLEARANCE - PHASE IV - PROJECT
<br />NO. 98-03
<br />Mr. Caldwell advised that Mr. Toy Villa, Public Construction Manager has submitted Change Order
<br />No. 2 (Final), on behalf of Warner and Sons, Inc., Post Office Box 87, Elkhart, Indiana, indicating
<br />that the contract amount be increased $0 for a new contract sum including this Change Order in the
<br />amount of $34,772.50. Additionally submitted was the Project Completion Affidavit indicating this
<br />new final cost. Upon a motion made by Mr. Caldwell, seconded by Mr. Powell and carried, Change
<br />Order No. 2 (Final) and the Project Completion Affidavit were approved.
<br />APPROVE FINAL CHANGE ORDER AND PROJECT COMPLETION AFFIDAVIT RIVER
<br />PARK PARTNERSHIP CENTER SIDEWALK, CURB AND APPROACH REPAIRS - PROJECT
<br />NO. 97-35
<br />Mr. Caldwell advised that Mr. Toy Villa, Public Construction Manager has submitted the Final
<br />Change Order on behalf ofBatteast Construction Company, 430 East LaSalle, South Bend, Indiana,
<br />indicating that the contract amount be increased by $3,623.00 for a new contract sum including this
<br />Change Order in the amount of $49,750.70. Additionally submitted was the Project Completion
<br />Affidavit indicating this new final cost. Upon a motion made by Mr. Powell, seconded by Mr.
<br />Caldwell and carried, the Final Change Order and the Project Completion Affidavit were approved
<br />subject to the filing of the appropriate three-year Maintenance Bond.
<br />APPROVE CONSTRUCTION CONTRACT - WILLIAM RICHARDSON DRIVE EXTENSION -
<br />PROJECT NO. 98-52
<br />Mr. Caldwell advised that in accordance with the bid awarded on July 6, 1998, to Walsh and Kelly,
<br />Inc., 24358 State Road 23, South Bend, Indiana, in the amount of $76,742.50 for the above referred
<br />to project, a Contract in said amount was being submitted for Board approval. Upon a motion made
<br />by Mr. Caldwell, seconded by Mr. Powell and carried, the Contract was approved and the appropriate
<br />Certificate of Insurance, Performance Bond and Labor and Materials Payment Bond as submitted
<br />were filed.
<br />APPROVE CONSTRUCTION CONTRACT - RIVER PARK PARTNERSHIP CENTER SERVICE
<br />AREA - PROJECT NO. 98-22
<br />Mr. Caldwell advised that in accordance with the bid awarded on July 20, 1998, to Rieth Riley
<br />Construction, 25200 State Road 23, South Bend, Indiana, in the amount of $51,147.3 8 for the above
<br />referred to project, a Contract in said amount was being submitted for Board approval. Upon a
<br />motion made by Mr. Caldwell, seconded by Mr. Powell and carried, the Contract was approved and
<br />the appropriate Certificate of Insurance, Performance Bond and Labor and Materials Payment Bond
<br />as submitted were filed.
<br />APPROVE CONSTRUCTION CONTRACT - MORRIS PERFORMING ARTS CENTER -
<br />STAGEHOUSE DEMOLITION - PROJECT NO. 98-25-3C
<br />Mr. Caldwell advised that in accordance with the bid awarded on July 13, 1998, to LaFree
<br />Excavating, Inc., 1251 West Third Street, Osceola, Indiana, in the amount of $234,245.00 for the
<br />above referred to project, a Contract in said amount was being submitted for Board approval. Upon
<br />a motion made by Mr. Caldwell, seconded by Mr. Powell and carried, the Contract was approved and
<br />the appropriate Certificate of Insurance was filed.
<br />APPROVAL OF CONTRACT - SERVICES OF ASSISTANT CITY ATTORNEY -WORKFORCE
<br />DEVELOPMENT
<br />Mr. Caldwell stated that the Board is in receipt of a Contract between the City of South Bend and
<br />Workforce Development, 425 North Michigan, South Bend, Indiana, for services of the Assistant
<br />City Attorney, Jeff Jankowksi, for WDS to provide advice and assistance on legal matters relating
<br />to the conduct of the WDS program during the July 1, 1998 through June 30,1999 period.
<br />Therefore, upon a motion made by Mr. Powell, seconded by Mr. Caldwell and carried, the Contract
<br />was approved and executed.
