<br />APPROVAL OF AGREEMENT - PLANNING SERVICES - WESTERN AVENUE
<br />COMMERCIAL CORRIDOR - BUSINESS DISTRICTS,_ INC.
<br />Mr. Caldwell stated that the Board is in receipt of an Agreement between the City of South Bend and
<br />Business Districts, Inc., 627 Grove Street, Evanston, Illinois 60201, for professional and technical
<br />assistance in connection with the Western Avenue Commercial Corridor Revitalization Plan. Mr.
<br />Caldwell noted that the Agreement is in the amount of $23,500.00. Therefore, upon a motion made
<br />by Mr. Caldwell, seconded by Ms. Roemer and carried, the Agreement was approved and executed.
<br />APPROVE CONSTRUCTION CONTRACT - SOUTHEAST NEIGHBORHOOD PARTNERSHIP
<br />CENTER SERVICE AREA - PROJECT NO. 98-21
<br />Mr. Caldwell advised that in accordance with the bid awarded on June 22, 1998, to Walsh and Kelly,
<br />Inc., 24358 State Road 23, South Bend, Indiana, in the amount of $59.024.00 for the above referred
<br />to project, a Contract in said amount was being submitted for Board approval. Upon a motion made
<br />by Mr. Caldwell, seconded by Ms. Roemer and carried, the Contract was approved and the
<br />appropriate Certificate of Insurance, Performance Bond and Labor and Materials Payment Bond as
<br />submitted were filed.
<br />APPROVE CONSTRUCTION CONTRACT - WESTSIDE PARTNERSHH' CENTER SERVICE
<br />AREA - PROJECT NO. 98-23
<br />Mr. Caldwell advised that in accordance with the bid awarded on June 22, 1998, to Niles Concrete
<br />Sawing and Construction, 2580 East Detroit Road, Niles Michigan, in the amount of $63,050.00 for
<br />the above referred to project, a Contract in said amount was being submitted for Board approval.
<br />Upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the Contract was
<br />approved and the appropriate Certificate of Insurance, Performance Bond and Labor and Materials
<br />Payment Bond as submitted were filed.
<br />APPROVE CONSTRUCTION CONTRACT - NEAR WESTSIDE PARTNERSHIP CENTER
<br />SERVICE AREA - PROJECT NO. 98-20
<br />Mr. Caldwell advised that in accordance with the bid awarded on June 22, 1998, to Niles Concrete
<br />Sawing and Construction, 2580 East Detroit Road, Niles Michigan, in the amount of $51,325.50 for
<br />the above referred to project, a Contract in said amount was being submitted for Board approval.
<br />Upon a motion made by Ms. Roemer, seconded by Mr. Caldwell and carried, the Contract was
<br />approved and the appropriate Certificate of Insurance, Performance Bond and Labor and Materials
<br />Payment Bond as submitted were filed.
<br />APPROVE CHANGE ORDER - NIMTZ PARKWAY ACCESS ROAD LANDSCAPING -
<br />PROJECT NO. 95-18-6
<br />Mr. Caldwell advised that Mr. Toy Villa, Public Construction Manager, has submitted the Final
<br />Change Order on behalf of Hunziker's Inc., 2344 Yankee Street, Niles, Michigan indicating that the
<br />Contract amount be decreased $247.00 for a new Contract sum including this Change Order in the
<br />amount of $117,235.00. Upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and
<br />carried, the Change Order was approved.
<br />FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY
<br />Mr. Caldwell indicated that the Common Council has submitted to the Board a Vacation Petition as
<br />completed by Mr. and Mrs. Ralph Layne, 1802 Prairie Avenue, South Bend, Indiana to vacate the
<br />following alley:
<br />The first east west alley south of S. Prairie Avenue from the west right of way line of the S.
<br />Swygart Avenue to the east right of way line of the first north south alley west of S. Swygart
<br />Avenue for a distance of approximately 128 feet and a width of approximately 13.2 feet. Part
<br />situated in Perkin's Subdivision & Unrecorded in the City of South Bend, St. Joseph County,
<br />Indiana.
<br />Mr. Caldwell advised that the Board is in receipt of favorable recommendations concerning this
<br />Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation,
<br />Department of Economic Development and the Department of Public Works. Therefore, Ms.
<br />Roemer made a motion that the Board send a favorable recommendation to the Common Council
