Berst's <br />Subdivision of Bank Out Lot 73 of the First Plat of Outlots of the Town, now City of South <br />Bend, in St. Joseph County, Indiana, platted by the State Bank of Indiana, which part is <br />bounded by a line running as follows: Beginning 7 feet North of the Southwest corner of said <br />Lot 13; thence North 37 feet; thence East 130.59 feet; thence South 37 feet to a point 7 feet <br />North of the South line of said Lot 13; thence West to the place of beginning. Commonly <br />known as 210-212 South Chapin Street. Key No. 18 3050 1949. <br />WHEREAS, the care, custody and control of City -owned real estate is vested in the Board <br />of Public Works pursuant to I.C. 36-9-6-3 and 36-1-11-1, et seq.; and <br />WHEREAS, South Bend Heritage Foundation, Inc., (hereinafter "SBHF"), an Indiana <br />not -for -profit corporation meeting the requirements of I.C. 36-1-11-1(a)(7), desires to obtain <br />ownership of the above -described real estate; and <br />WHEREAS, the use of said property for such purposes will be beneficial to the community, <br />and the City is willing to transfer said property to SBHF for the aforementioned purpose. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South <br />Bend, Indiana, as follows: <br />1) The City shall transfer to SBHF two (2) parcels of real property more particularly <br />described as follows: <br />A part of Lots Numbered Eleven (11) and Twelve (12) as shown on the recorded Plat of <br />Hiram F. Berst's Subdivision of Bank Out Lot Number Seventy-three (73) of the First Plat <br />of Out Lots of the Town, now City of South Bend, platted by the State Bank of Indiana, <br />which part is bounded by a line running as follows, viz: Beginning at a point 108 feet West <br />of the Northeast corner of Lot Numbered Fourteen (14) in said Subdivision; thence running <br />West on the North line of said Sublot Number Eleven (11) to the Northwest corner thereof, <br />thence South on the East line of Chapin Street in said City 71 feet; thence East to a point due <br />South of the place of beginning; thence North 71 feet to the place of beginning. Key No. 18 <br />3050 1947; and <br />A part of Lot Numbered Thirteen (13) as shown on the recorded Plat of Hiram F.
