REGULAR MEETING JUKE 14, 1999 <br />by Ms. Roemer, seconded by Mr. Caldwell and carried, the Contract was approved and the <br />appropriate Certificate of Insurance, Performance Bond and Labor and Materials Payment Bond as <br />submitted were filed. <br />APPROVAL OF AGREEMENTS -BUILDING BLOCK GRANT AGREEMENTS <br />Mr. Caldwell stated that the Board is in receipt of two (2) Building Block Grant Agreements. Angela <br />Bushes/Trees <br />$100.00 <br />James Husband <br />3914 Springbrook <br />Flowers/Plants/Cobblestone <br />$100.00 <br />Therefore, upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the <br />Agreements were approved and executed. <br />APPROVAL OF REQUEST TO ADVERTISE FOR THE RECEIPT OF BIDS U.S. 31 <br />INDUSTRIAL PARK - PHASE II - PROJECT NO 99-22 <br />In a memorandum to the Board, Mr. Carl Littrell, City Engineer, requested permission to advertise <br />for the receipt of bids for the above referred to project. Mr. Littrell stated that this project will <br />construct sanitary sewer, lift station, water main, drainage and roadway construction in the area of <br />Brick Road and the U.S. 31 Bypass. Funding is provided by the Blackthorn Area Economic <br />Development Tax Increment Fund. Therefore, upon a motion made by Ms. Roemer, seconded by <br />Mr. Powell and carried, the request to advertise for the receipt of bids was approved. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE A STREET <br />Mr. Caldwell indicated that the Common Council has submitted to the Board a Vacation Petition as <br />completed by Mr. Bruce Bancroft, Memorial Hospital, 615 North Michigan, South Bend, Indiana to <br />vacate the following street: <br />West Navarre Street from the east right of way of North Main Street to the east right of way <br />ofNorth Lafayette Street for a distance of approximately 443 feet and a width of 82.5 feet. <br />Part located in South Bend. (Original Town) City of South Bend, St. Joseph County. <br />Mr. Bancroft was present, and stated that Memorial Hospital has met with the South Bend Medical <br />Foundation, as well as adjacent neighbors, and they concur with this vacation. Mr. Bancroft stated <br />that Navarre Street will not be closed to traffic, it would become the property of the hospital. They <br />are aware that they would be responsible for all maintenance of this street if vacated. Mr. Caldwell <br />advised that the Board is in receipt of favorable recommendations concerning this Vacation Petition <br />from the Area Plan Commission, Police Department, Fire Department, Sanitation, Department of <br />Economic Development and the Department of Public Works. Therefore, Mr. Caldwell made a <br />motion that the Board send a favorable recommendation to the Common Council concerning this <br />Vacation Petition, subject to a turn -around at the end of Main Street. Ms. Roemer seconded the <br />motion which carried. <br />APPROVAL OF RECOMMENDATION - LICENSE APPLICATION - SIDEWALK CAFE - <br />HIGHER GROUNDS - 109 WEST WASHINGTON <br />Mr. Caldwell stated that favorable recommendations have been received by the Division of <br />Engineering, Code Enforcement, Building Commissioner, Fire Department and the City Attorney's <br />office, in reference to a request as submitted by Mr. Ronald Martin, Higher Grounds, 109 West <br />Washington, South Bend, Indiana to use a portion of the property in front of his establishment for <br />a sidewalk cafe. Upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the <br />recommendation was approved. <br />APPROVAL OF RECOMMENDATION - TO ENCROACH ONTO PUBLIC RIGHT OF WAY - <br />1342 EAST WAYNE NORTH <br />Mr. Caldwell stated that favorable recommendations have been received by the Division of <br />
