REGULAR MEETING JUKE 14, 1999 by Ms. Roemer, seconded by Mr. Caldwell and carried, the Contract was approved and the appropriate Certificate of Insurance, Performance Bond and Labor and Materials Payment Bond as submitted were filed. APPROVAL OF AGREEMENTS -BUILDING BLOCK GRANT AGREEMENTS Mr. Caldwell stated that the Board is in receipt of two (2) Building Block Grant Agreements. These agreements will convey the funds to the grantee to carry out the neighborhood physical improvement and beautification projects within the City of South Bend. Angela Bushes/Trees $100.00 James Husband 3914 Springbrook Flowers/Plants/Cobblestone $100.00 Therefore, upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the Agreements were approved and executed. APPROVAL OF REQUEST TO ADVERTISE FOR THE RECEIPT OF BIDS U.S. 31 INDUSTRIAL PARK - PHASE II - PROJECT NO 99-22 In a memorandum to the Board, Mr. Carl Littrell, City Engineer, requested permission to advertise for the receipt of bids for the above referred to project. Mr. Littrell stated that this project will construct sanitary sewer, lift station, water main, drainage and roadway construction in the area of Brick Road and the U.S. 31 Bypass. Funding is provided by the Blackthorn Area Economic Development Tax Increment Fund. Therefore, upon a motion made by Ms. Roemer, seconded by Mr. Powell and carried, the request to advertise for the receipt of bids was approved. FAVORABLE RECOMMENDATION - PETITION TO VACATE A STREET Mr. Caldwell indicated that the Common Council has submitted to the Board a Vacation Petition as completed by Mr. Bruce Bancroft, Memorial Hospital, 615 North Michigan, South Bend, Indiana to vacate the following street: West Navarre Street from the east right of way of North Main Street to the east right of way ofNorth Lafayette Street for a distance of approximately 443 feet and a width of 82.5 feet. Part located in South Bend. (Original Town) City of South Bend, St. Joseph County. Mr. Bancroft was present, and stated that Memorial Hospital has met with the South Bend Medical Foundation, as well as adjacent neighbors, and they concur with this vacation. Mr. Bancroft stated that Navarre Street will not be closed to traffic, it would become the property of the hospital. They are aware that they would be responsible for all maintenance of this street if vacated. Mr. Caldwell advised that the Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, Department of Economic Development and the Department of Public Works. Therefore, Mr. Caldwell made a motion that the Board send a favorable recommendation to the Common Council concerning this Vacation Petition, subject to a turn -around at the end of Main Street. Ms. Roemer seconded the motion which carried. APPROVAL OF RECOMMENDATION - LICENSE APPLICATION - SIDEWALK CAFE - HIGHER GROUNDS - 109 WEST WASHINGTON Mr. Caldwell stated that favorable recommendations have been received by the Division of Engineering, Code Enforcement, Building Commissioner, Fire Department and the City Attorney's office, in reference to a request as submitted by Mr. Ronald Martin, Higher Grounds, 109 West Washington, South Bend, Indiana to use a portion of the property in front of his establishment for a sidewalk cafe. Upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the recommendation was approved. APPROVAL OF RECOMMENDATION - TO ENCROACH ONTO PUBLIC RIGHT OF WAY - 1342 EAST WAYNE NORTH Mr. Caldwell stated that favorable recommendations have been received by the Division of
