The South Bend Redevelopment Commission is the <br />owner of the properties abutting the proposed encroachment. Upon a motion made by Ms. Roemer, <br />seconded by Mr. Powell and carried, the recommendation was approved. <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE ALLEYS <br />Mr. Powell indicated that the Common Council has submitted to the Board a Vacation Petition as <br />completed by Mr. Antony Zappia, Attorney, 52582 U.S. 31 North, South Bend, Indiana to vacate <br />the following alleys: <br />First east/west alley south of Western Avenue from the east right of way of South Albert <br />Street to the west right of way of South Sheridan Street for a distance of approximately <br />284.26 feet in length and a width of 14 feet. <br />Also, the first north/south alley west of South Sheridan from the south right of way of the first <br />east/west alley south of Western Avenue to the extended lot lines of Lots 437 and 426 for a <br />distance of approximately 108 feet in length and a width of 14 feet and including the angles <br />at the intersection of the east west alley. Parks located in Belleville 3rd unit. <br />Mr. Powell advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Police Department, Fire Department, and the Department of Economic <br />Development. Area Plan recommends approval subject to dedication of an east west alley to <br />Sheridan Street and approval of the rezoning of these lots to "C" commercial. Solid Waste is not in <br />favor of these vacations. Engineering stated that access must be permitted to the remaining public <br />alley. <br />Mr. John Ford, Attorney, representing approximately thirty (30) residents, was present, and <br />recommended that the Board give an unfavorable recommendation.
