<br />APPROVE FINAL CHANGE ORDER AND PROJECT COMPLETION AFFIDAVIT -
<br />SOUTHEAST NEIGHBORHOOD REDEVELOPMENT/DEMOLITION AND SITE
<br />CLEARANCE -PROJECT NO. 100-63
<br />Mr. Gilot advised that Mr. Toy Villa, Public Construction Manager, has submitted the Final Change
<br />Order on behalf of Grade -Rite, 12877 Industrial Drive, Granger, Indiana, with no monetary change,
<br />for a new contract sum including this Change Order in the amount of $10,800.00. Additionally
<br />submitted was the Project Completion Affidavit indicating this new final cost. Upon a motion made
<br />by Mr. Gilot, seconded by Mr. Inks and carried, the Final Change Order and the Project Completion
<br />Affidavit were approved subject to the filing of the appropriate three-year Maintenance Bond.
<br />APPROVAL OF RECOMMENDATION - TO CONDUCT JOHN ADAMS HIGH SCHOOL
<br />PARADE
<br />Mr. Gilot stated that favorable recommendations have been received by the Division of Engineering,
<br />Park Department, Police Department and the City Attorney's office, in reference to a request as
<br />submitted by Corporal David Newton, Adams High School, 808 South Twyckenham, South Bend,
<br />Indiana to conduct the above referred to parade, on October 13, 2000, beginning at 5:45 p.m., on the
<br />designated route as submitted. Upon a motion made by Mr. Inks, seconded by Mr. Gilot and carried,
<br />the recommendation was approved.
<br />APPROVAL OF RECOMMENDATION - TO CONDUCT ARTHRITIS FOUNDATION
<br />SOLICITATION
<br />Mr. Gilot stated that favorable recommendations have been received by the Division of Engineering,
<br />Police Department and the City Attorney's office, in reference to a request as submitted by Ms.
<br />Nancy Daniels, 922 Grand Boulevard, Mishawaka, Indiana to conduct the above referred to
<br />solicitation on October 7, 28 and November 11, 2000 at Portage and Cleveland Roads. Upon a
<br />motion made by Mr. Inks, seconded by Mr. Gilot and carried, the recommendation was approved,
<br />subject to the participants wearing protective vests and following the City of South Bend safety
<br />regime.
<br />DENY REQUEST TO PURCHASE OF CITY -OWNED PROPERTY - 238 EAST BOWMAN
<br />Mr. Gilot stated that an unfavorable recommendation has been received from the Division of
<br />Engineering in reference to a request as submitted by Mr. Elyorde Owensburg, 236 East Bowman,
<br />South Bend, Indiana to purchase the City -owned lot at 238 East Bowman. Mr. Carl Littrell, City
<br />Engineer, recommended that the City should retain this property as an additional right of way.
<br />However, the property may be used for a garden area. Upon a motion made by Mr. Gilot, seconded
<br />by Mr. Inks and carried, the recommendation was approved, and the Clerk of the Board will forward
<br />an application for a Garden Agreement to Mr. Owensburg.
<br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE
<br />Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to
<br />Remonstrate as submitted by Clay Ironwood, LLC. The Consent indicates that in consideration for
<br />permission to tap into the public sanitary sewer system of the City, to provide sanitary sewer service
<br />to 17690 St. Patrick Court, Granger, Indiana, South Bend, Indiana, (Key # 02-2013-0263.01 and 02-
<br />2013-0263.02), Clay Ironwood waives and releases any and all right to remonstrate against or oppose
<br />any pending or future annexation of the property by the City of South Bend. Therefore, Mr. Gilot
<br />made a motion that the Consent be approved. Mr. Inks seconded the motion which carried.
<br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE
<br />Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to
<br />Remonstrate as submitted by Mr. Thomas Emery, 4306 Hickory Road, Mishawaka, Indiana. The
<br />Consent indicates that in consideration for permission to tap into the public sanitary sewer system of
<br />the City, to provide sanitary sewer service to Lot 59, 60 and 61 Fulkerson Park Subdivision, South
<br />Bend, Indiana, (Key # 02-1050-1495, 02-1050-1946, and 02-1050-1947.01), the Emery waives and
<br />releases any ar_.d all right to remonstrate against or oppose any pending or future annexation of the
<br />property by the City of South Bend. Therefore, Mr. Gilot made a motion that the Consent be
<br />approved. Mr. Inks seconded the motion which carried.
