<br />APPROVAL OF SETTLEMENT AGREEMENT - ALLIED PRODUCTS NEGOTIATIONS
<br />Mr. Gilot stated that the Board is in receipt of an Agreement between the City of South Bend and
<br />Allied Products Corporation for the settlement agreement for the purchase of two (2) properties (701
<br />South Chapin and 601 West Broadway) in a bankruptcy case. Therefore, upon a motion made by
<br />Mr. Gilot, seconded by Mr. Inks and carried, the Agreement was approved and executed.
<br />APPROVAL OF AMENDMENT TO AGREEMENT - CLARIFIER IMPROVEMENTS -
<br />WASTEWATER TREATMENT PLANT - TRIAD ENGINEERING
<br />Mr. Gilot stated that the Board is in receipt of an Amendment to an Agreement between the City of
<br />South Bend and Triad Engineering, 300 North Michigan, South Bend, Indiana, for improvements
<br />to the clarifiers at the Wastewater Treatment Plant. Mr. Gilot noted that the Amendment is in the
<br />amount of $14,850.00, bringing the Agreement amount to $697,820.00. Therefore, upon a motion
<br />made by Mr. Gilot, seconded by Mr. Inks and carried, the Amendment to the Agreement was
<br />approved and executed.
<br />APPROVAL OF STAFF AGREEMENT - INDUSTRIAL REVOLVING FUND
<br />Mr. Gilot stated that the Board is in receipt of an Agreement between the City of South Bend and
<br />the Industrial Revolving Fund for staff support for the period of January 1, 2002 through December
<br />31,2003. Mr. Gilot noted that the Agreement is in the amount of $50,200.00 for 2002 and
<br />$51,950.00 for 2003. Therefore, upon a motion made by Mr. Gilot, seconded by Mr. Inks and
<br />carried, the Agreement was approved and executed.
<br />APPROVAL OF CONTRACT - CLEAN OUT OF ORGANIC RESOURCES LAGOON 41 -
<br />RESOURCE CONSERVATION SERVICES LLC
<br />Mr. Gilot stated that the Board is in receipt of a Contract between the City of South Bend and
<br />Resource Conservation Services, 14466 S. 1050 W., Wanatah, Indiana, for the above referred to
<br />project, which was awarded on November 16, 2001. Therefore, upon a motion made by Mr. Gilot,
<br />seconded by Mr. Littrell and carried, the Contract was approved and executed.
<br />APPROVE CONSTRUCTION CONTRACT - LEEPER PARK/RIVERSIDE DRIVE - PARKING
<br />IMPROVEMENTS - PROJECT NO. 101-035
<br />Mr. Gilot advised that in accordance with the bid awarded on October 8, 2001, to Rieth Riley
<br />Construction, Post Office Box 1775, South Bend, Indiana, in the amount of $99,533.96 for the above
<br />referred to project, a Contract in said amount was being submitted for Board approval. Upon a
<br />motion made by Mr. Littrell, seconded by Mr. Inks and carried, the Contract was approved and the
<br />appropriate Certificate of Insurance, Performance Bond and Labor and Materials Payment Bond as
<br />submitted were filed.
<br />APPROVAL OF RECOMMENDATION - TO ENCROACH ONTO PUBLIC RIGHT OF WAY -
<br />INSTALLATION OF AWNING - 2123 MIAMI STREET
<br />Mr. Gilot stated that favorable recommendations have been received by the Division of Engineering,
<br />Building Department, Fire Department, Police Department and the City Attorney's office, in
<br />reference to a request as submitted by Ms. Joan Ross, Ross Drafting Services, 2123 Miami, South
<br />Bend, Indiana, for the installation of an awning at 2123 Miami Street. Upon a motion made by Mr.
<br />Gilot, seconded by Mr. Inks and carried, the recommendation was approved.
<br />FAVORABLE RECOMMENDATION - PETITION TO VACATE TWO (2) ALLEYS FIRST
<br />EAST/WEST ALLEY NORTH OF ORANGE STREET
<br />Mr. Gilot indicated that the Common Council has submitted to the Board a Vacation Petition as
<br />completed by Mr. Larry Magliozzi, Planning Department to vacate the following alleys:
<br />The first east/west alley north of Orange Street from Johnson Street to the first
<br />north/south alley; the second alley to be vacated is the first north/south alley east of
<br />Johnson Street from the first east/west alley north of Orange Street, both being a part
<br />of Lot 20, College Grove Addition to the City of South Bend, St. Joseph County,
<br />Indiana.
<br />Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this
<br />Vacation Petition from the Police Department, Fire Department, Bureau of Sanitation, Department
