REGULAR MEETING <br />JUNE 25, 2001 <br />The street to be vacated is Kale Street, a part of Edison Road Addition and is descried as <br />beginning a the first north/south alley west of Hickory Road; thence west a distance of 420 <br />feet more or less, to th west line of said Edison Road Addition and having a width of 60 feet. <br />Being a part of said Edison Road Addition to the City of South Bend, Clay Township, St. <br />Joseph County, Indiana. <br />Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Police Department, Fire Department, Department of Economic <br />Development and the Department of Public Works. Solid Waste did not submit a recommendation. <br />Mr. Carl Littrell, City Engineer submitted a favorable but conditional recommendation. The parcels <br />of real estate contiguous to the part of Kale Street proposed for vacation are owned by three parties. <br />The properties of two of the owners are all the properties on the south side of Kale. These owners <br />are partners in development of the real estate for a grocery and office use that is in the process of <br />being re -zoned for those uses. The remaining contiguous property is owned by American Electric <br />Power Company (AEP). AEP is not a petitioner on the vacation petition. It is recommended that the <br />Board approve this petition with the condition that American Electric Power acknowledge that they <br />do not object to the fact that if the vacation becomes effective, all but two of the parcels of real estate <br />would have no public access. Since the power company has suspended a large electrical transmission <br />line above this real estate, it seems apparent that this will not be a burden for them. However, this <br />may change in the future. Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, <br />the Board approved the property vacation. <br />ADOPT RESOLUTION NO. 36-2001 - APPROVING AN ORDINANCE TO EXTEND AND <br />PROVIDE SEWER SERVICES TO AN AREA WITHIN TEN MILES OUTSIDE THE <br />MUNICIPAL CITY LIMITS KNOWN AS A PORTION OF POPPY ROAD IN WARREN <br />TOWNSHIP. ST. JOSEPH COUNTY, INDIANA <br />Upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried, the following Resolution was <br />adopted by the Board of Public Works: <br />WHEREAS, there has been submitted to the Common Council of the City of South Bend an <br />ordinance to extend and provide sewer serviced to an area within ten miles outside the municipal <br />limits of the City of South Bend, specifically, on Poppy Road between U.S. 20 and old Cleveland <br />Road in Warren Township, St. Joseph County, Indiana. <br />WHEREAS, the Board of Public Works now desires to approve and recommend the <br />Common Council's adoption of said ordinance. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE <br />CITY OF SOUTH BEND AS FOLLOWS: <br />Section I. That it is in the best interest of the City of South Bend that the Department <br />of Public Works be authorized to extend and construct sewer main lines to <br />an area outside the municipal limits of the City of South Bend, specifically, <br />on Poppy Road between U.S. 20 and old Cleveland Road in warren <br />Township, St. Joseph County, Indiana. <br />Section II. That the Board of Public Works approves and recommends the Common <br />Council's adoption and enactment of its ordinance extending and providing <br />sewer service to the area on Poppy Road between U.S. 20 and Old Cleveland <br />Road in Warren Township, St. Joseph county, Indiana and further providing <br />for the recoupment of a portion of the costs of such construction from the <br />owners of the property affected by the sewer main extension project and to <br />seek cost reimbursement from affected property owners upon hook-up. <br />Adopted the 21 S` day of June, 2001. <br />
