REGULAR MEETING <br />Lawson Fisher Associates, P.C. <br />Dan Lawson <br />525 West Washington Avenue, Ste. 200 <br />South Bend, Indiana 46601 <br />MAY 14, 2001 <br />Kenneth Grove Sr. Concrete <br />52600 Olive Road <br />South Bend, Indiana 46628 <br />APPROVAL OF GRANT OF EASEMENT - SANITARY SEWER - 61087 U.S. 31 <br />Upon a motion made by Mr. Gilot, seconded by Ms. Roemer and carried, the Grant of Easement for <br />61087 U.S. 31, for the installation of a sewer system was approved. <br />APPROVAL OF GRANT OF TEMPORARY EASEMENT - SANITARY SEWER - 61281 U.S. <br />31 <br />Upon a motion made by Mr. Gilot, seconded by Ms. Roemer and carried, the Temporary Grant of <br />Easement for 61281 U.S. 31, for the installation of a sewer system was approved. <br />APPROVAL OF GRANT OF TEMPORARY EASEMENT - SANITARY SEWER AND WATER - <br />61271 U.S. 31 SOUTH <br />Upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried, the Grant of Temporary <br />Easement for 61271 U.S. 31 South for the installation of sanitary sewer and water installation was <br />approved. <br />APPROVE IRREVOCABLE STANDBY LETTER OF CREDIT• <br />Mr. Tony Molnar, Division of Engineering, submitted the following Irrevocable Standby Letter of <br />Credit to the Board and recommended approval: <br />IRREVOCABLE STANDBY LETTER OF CREDIT NO. 125 <br />ISSUED BY: First Federal Savings Bank <br />FOR: Royal Oak Estates Subdivision, Phase I <br />AMOUNT: $16,500.00 <br />EXPIRES: October 31. 2001 <br />IMPROVEMENT: Completion of To Coat of Pavement on the Roadways <br />Mr. Gilot made a motion that the Letter of Credit, as outlined above, be approved. Ms. Roemer <br />seconded the motion which carried. <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE <br />Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to <br />Remonstrate as submitted by Mr. and Mrs. Mark Malstaff, 60981 US 31 South, South Bend, Indiana. <br />The Consent indicates that in consideration for permission to tap into the public sanitary sewer <br />system of the City, to provide sanitary sewer service to the northwest corner of US 31 South and <br />Kern Road, South Bend, Indiana, (Key# #01-1017-0369 and 01-1017-0369,01), the Malstaff's waive <br />and release any and all right to remonstrate against or oppose any pending or future annexation of <br />the property by the City of South Bend. Therefore, Mr. Gilot made a motion that the Consent be <br />approved. Ms. Roemer seconded the motion which carried. <br />APPROVE AND/OR RELEASE CONTRACTOR AND EXCAVATION BONDS <br />Mr. Anthony Molnar, Engineer, Division of Engineering, recommended that the following <br />Contractors and Excavation Bonds be approved and/or released as follows: <br />BOND OF CONTRACTOR <br />Niezgodski Plumbing <br />Gibson Lewis LLC <br />Henry Calzada <br />Approved Effective April 26, 2001 <br />Pursuant to Res.
