REGULAR MEETING Lawson Fisher Associates, P.C. Dan Lawson 525 West Washington Avenue, Ste. 200 South Bend, Indiana 46601 MAY 14, 2001 Kenneth Grove Sr. Concrete 52600 Olive Road South Bend, Indiana 46628 APPROVAL OF GRANT OF EASEMENT - SANITARY SEWER - 61087 U.S. 31 Upon a motion made by Mr. Gilot, seconded by Ms. Roemer and carried, the Grant of Easement for 61087 U.S. 31, for the installation of a sewer system was approved. APPROVAL OF GRANT OF TEMPORARY EASEMENT - SANITARY SEWER - 61281 U.S. 31 Upon a motion made by Mr. Gilot, seconded by Ms. Roemer and carried, the Temporary Grant of Easement for 61281 U.S. 31, for the installation of a sewer system was approved. APPROVAL OF GRANT OF TEMPORARY EASEMENT - SANITARY SEWER AND WATER - 61271 U.S. 31 SOUTH Upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried, the Grant of Temporary Easement for 61271 U.S. 31 South for the installation of sanitary sewer and water installation was approved. APPROVE IRREVOCABLE STANDBY LETTER OF CREDIT• Mr. Tony Molnar, Division of Engineering, submitted the following Irrevocable Standby Letter of Credit to the Board and recommended approval: IRREVOCABLE STANDBY LETTER OF CREDIT NO. 125 ISSUED BY: First Federal Savings Bank FOR: Royal Oak Estates Subdivision, Phase I AMOUNT: $16,500.00 EXPIRES: October 31. 2001 IMPROVEMENT: Completion of To Coat of Pavement on the Roadways Mr. Gilot made a motion that the Letter of Credit, as outlined above, be approved. Ms. Roemer seconded the motion which carried. APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by Mr. and Mrs. Mark Malstaff, 60981 US 31 South, South Bend, Indiana. The Consent indicates that in consideration for permission to tap into the public sanitary sewer system of the City, to provide sanitary sewer service to the northwest corner of US 31 South and Kern Road, South Bend, Indiana, (Key# #01-1017-0369 and 01-1017-0369,01), the Malstaff's waive and release any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore, Mr. Gilot made a motion that the Consent be approved. Ms. Roemer seconded the motion which carried. APPROVE AND/OR RELEASE CONTRACTOR AND EXCAVATION BONDS Mr. Anthony Molnar, Engineer, Division of Engineering, recommended that the following Contractors and Excavation Bonds be approved and/or released as follows: BOND OF CONTRACTOR Niezgodski Plumbing Gibson Lewis LLC Henry Calzada Approved Effective April 26, 2001 Pursuant to Res.
