00 4 <br />REGULAR MEETING <br />FEBRUARY 26, 2001 <br />allow a better plan and prioritize projects aimed at improving the water quality. Mr. Gilot noted that <br />the Agreement is in the amount of $53,520.00. Therefore, upon a motion made by Mr. Inks, <br />seconded by Ms. Roemer and carried, the Agreement was approved and executed. <br />APPROVAL OF STATEILOCAL AGENCY AGREEMENT - CORBY AND HICKORY <br />IMPROVEMENTS - INDIANA DEPARTMENT OF TRANSPORTATION <br />Mr. Gilot stated that the Board is in receipt of an Agreement between the City of South Bend and <br />the Indiana Department of Transportation, for improvements at Hickory and Corby Streets. <br />Therefore, upon a motion made by Mr. Inks, seconded by Ms. Roemer and carried, the Agreement <br />was approved and executed. <br />APPROVAL OF REQUEST TO EXTEND TWO-WAY COMMUNICATION EQUIPMENT <br />REPAIR SERVICES TO THE ST. JOSEPH COUNTY POLICE AND HIGHWAY <br />DEPARTMENTS <br />In a letter to the Board, Mr. Matthew Chlebowski, Director, Equipment Services, recommended <br />approval to extend two-way communication equipment repair services to the St. Joseph County <br />Police and Highway Departments. The company currently providing these services will no longer do <br />so as of March 1, 2001. Mr. Chlebowski indicated he has proposed a pilot program where the <br />County will be billed at the standard rate of $45.00 per hour and 20% mark up on parts. The radio <br />equipment used by the County is very similar. At this time, there are no start up costs or additional <br />staffing needed for this program. Therefore, upon a motion made by Mr. Gilot, seconded by Ms. <br />Roemer and carried, the request was approved. <br />APPROVAL OF EXTENSION OF PILOT PROGRAM - DOWNTOWN COMMERCIAL <br />DELIVERY <br />In a memorandum to the Board, Mr. Michael Giulioni, Community and Economic Development, <br />requested the Board extend the Downtown Commercial Delivery Permit Pilot Program for an <br />additional ninety (90) days, to formalize the program through necessary legislation and administrative <br />guidelines. Mr. Giulioni stated that he had met with Mr. Andy Ujdak, Councilmember, to present him <br />an overview of the program. Mr. Giulioni will present the program at the February 26, 2001 City <br />Council meeting, and the process will be formalized by Municipal Code. Upon a motion made by Mr. <br />Inks, seconded by Ms. Roemer and carried, the request was approved. <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY <br />Mr. Gilot indicated that the Common Council has submitted to the Board a Vacation Petition as <br />completed by Mr. Theo Medow, 918 East Jefferson, South Bend, Indiana to vacate the following <br />alley: <br />The 10 foot wide alley lying north of, and adjacent to Lot 1, the 10 foot wide alley lying south <br />of, and adjacent to Lot 47, the 12 foot wide alley lying north of, and adjacent to Lots 5 and <br />46 and the 12 foot wide alley lying east of, and adjacent to Lots 1 through 5 inclusive all <br />within and a part of Hartman and Miller's Plat in the City of South Bend, Indiana. <br />Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this Vacation <br />Petition from the Police Department and Fire Department. The Area Plan Commission stated that <br />it appears that the north south alley is currently used for garbage pick up. If the north/south alley <br />from the north right of way line of South Bend Avenue to the south right of way line of the first <br />east/west alley south of St. Vincent Street and the first east/west alley south of St. Vincent Street are <br />vacated, it would result in the creation of a dead-end alley for alley traffic from the north. Since it <br />is the City Council's policy not to allow the creation of dead-end alleys, Area Plan and Community <br />and Economic Development recommend denial of this petition. The Division of Engineering concurs. <br />Solid Waste is in favor, but will need notification if the recommendation to vacate this alley is <br />approved. An egress/ingress situation would need to be resolved, as well as an order of plan, rather <br />than a perspective plan. Therefore, Mr. Gilot made a motion that the Board send an unfavorable <br />recommendation to the Common Council concerning this Vacation Petition. Ms. Roemer seconded <br />the motion which carried. <br />E <br />1 <br />1 <br />
