0332 _ <br />REGULAR MEETING DECEMBER 9, 2002 <br />The Engineering Division had no objection if the alley between Lots 261 and 262 are replaced by <br />a public ingress/egress easement and accommodation for turning vehicles as proposed in a separate <br />site plan. Community and Economic Development strongly supports this vacation request. It is an <br />initial part of the planned development project on the southwest corner of Main and Jefferson. The <br />Area Plan Commission staff reviewed the petition and believes vacating this alley would pose <br />several problems. Vacating these alleys would go against a Common Council policy of not creating <br />dead end alleys. Several parking lots would not have adequate access to their lots. Cross -access <br />easements would be necessary. Each future development on this block would be forced to create <br />new curb cuts for any loading and parking areas. Such a practice is opposite to what is desirable in <br />the downtown area. It appears as though utilities are present in the proposed vacation area. Utility <br />easements would be necessary. The Police Department and Fire Department have no objections. <br />Upon a motion made by Mr. Littrell, seconded by Mr. Inks and carried, this alley vacation was <br />approved, subject to the above comments. <br />APPROVE CONSTRUCTION CONTRACT - PORTAGE AVENUE SEWER EXTENSION <br />(TEACHERS CREDIT UNION) - HERRMAN & GOETZ INC - PROJECT NO 102-077 <br />Mr. Gilot advised that in accordance with the quotation awarded on November 25, 2002, to Herrman <br />& Goetz d/b/a Underground Services, 225 South Lafayette Boulevard, South Bend, Indiana, in the <br />amount of $43,739.75 for the above referred to project, a Contract in said amount was being <br />submitted for Board approval. Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and <br />carried, the Contract was approved and the appropriate Certificate of Insurance and Schedule of <br />Wages as submitted were filed. <br />APPROVE CONSTRUCTION CONTRACT -U.S. 31 TRUNK SEWER EXTENSION - YOUNGS <br />EXCAVATING - PROJECT NO. 102-062 <br />Mr. Gilot advised that in accordance with the quotation awarded on November 12, 2002, to Youngs <br />Excavating, Inc., Post Office Box 2766, South Bend, Indiana, in the amount of $466,332.00 for the <br />above referred to project, a Contract in said amount was being submitted for Board approval. Upon <br />a motion made by Mr. Inks, seconded by Mr. Gilot and carried, the Contract was approved and the <br />appropriate Certificate of Insurance, Performance Bond and Labor and Materials Payment Bond as <br />submitted were filed. <br />APPROVE SERVICE CONTRACT - ENVIRONMENTAL OVERSIGHT DURING TJX <br />DEMOLITION, GRADING AND DRAINAGE PROJECT - WEAVER BOOS & GORDON OF <br />MICHIANA, LLC - PROJECT NO. 102-034C <br />Mr. Gilot stated that the Board is in receipt of a Service Contract between the City of South Bend <br />and Weaver Boos & Gordon of Michiana, LLC, 630 East Bronson Street, Suite 1, South Bend, <br />Indiana, for environmental monitoring during site construction. Mr. Gilot noted that the Service <br />Contract will be satisfied on an hourly basis. Therefore, upon a motion made by Mr. Littrell, <br />seconded by Mr. Gilot and carried, the Service Contract was approved and executed. <br />APPROVAL OF SERVICE CONTRACT - WALNUT/EUCLID CONTROL STRUCTURE <br />IMPROVEMENTS - LAWSON-FISHER ASSOCIATES P.C. <br />Mr. Gilot stated that the Board is in receipt of a Service Contract between the City of South Bend <br />and Lawson -Fisher Associates, Inc., 525 West Washington Avenue, South Bend, Indiana, for <br />engineering services. Mr. Gilot noted that the Contract is in the amount of $23,400.00. Therefore, <br />upon a motion made by Mr. Littrell, seconded by Mr. Inks and carried, the Service Contract was <br />approved and executed. <br />APPROVAL OF SERVICE CONTRACT - ENROLL TJX DEMOLITION INTO THE <br />VOLUNTARY REMEDIATION PROGRAM - WEAVER BOOS & GORDON - PROJECT NO. <br />102-034CD <br />Mr. Gilot stated that the Board is in receipt of a Service Contract between the City of South Bend <br />and Weaver Boos & Gordon of Michiana, LLC, 630 East Bronson Street, Suite 1, South Bend, <br />Indiana, for enrollment into the Voluntary Remediation Program for the TJX Demolition Project. <br />Mr. Gilot noted that the Service Contract is a 50/50 split with the City's portion not to exceed <br />$200,000.00. Therefore, upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried, the <br />Service Contract was approved and executed. <br />C <br />H <br />
