<br />FAVORABLE RECOMMENDATION -PETITION TO VACATE AN ALLEY -NORTH/ SOUTH
<br />ALLEY BETWEEN LOTS 50 AND 51 OF RAFF'S 3RDADDITION NORTH OF INDIANA
<br />AVENUE AND BETWEEN CATALPA AND CHAPIN STREETS
<br />Mr. Littrell indicated that Mr. Jack Kendall, 815 West Indiana, South Bend, Indiana, has submitted
<br />a request to vacate the above referred to alley. Mr. Gilot advised that the Board is in receipt of
<br />favorable recommendations concerning this Vacation Petition from the Area Plan Commission,
<br />Police Department, Fire Department, Sanitation, Department of Economic Development and the
<br />Department of Public Works. Area Plan and Engineering stated that the petitioner needs to provide
<br />a means of accomplishing truck turns at the "T' intersection. The alley approach at Indiana must be
<br />replaced with curb and sidewalk. In addition, if this alley is vacated, it be done so subject to any
<br />utility easements that are necessary Therefore, Mr. Gilot made a motion that the Clerk send a letter
<br />to the petitioner addressing these concerns. Mr. Inks seconded the motion which carried.
<br />FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY - FIRST
<br />NORTH/SOUTH ALLEY EAST OF NILES_AVENUE
<br />Mr. Littrell indicated that Mr. Bill Schalliol. Community & Economic Development, South Bend,
<br />Indiana, has submitted a request to vacate the above referred to alley. Mr. Gilot advised that the
<br />Board is in receipt of favorable recommendations concerning this Vacation Petition from the Police
<br />Department, Fire Department, Sanitation, Department of Economic Development and the
<br />Department of Public Works. Engineering stated that all abutting real estate should have common
<br />ownership. Area plan stated this public ingress/egress easement be vacated subject to any utility
<br />easements that are necessary. Mr. Gilot made a motion that the Clerk send a letter to the petitioner
<br />addressing these concerns. Mr. Inks seconded the motion which carried.
<br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE PROPERTY - THE 174
<br />FOOT PAPER STREET NORTH/SOUTH OFF TWIXWOOD - DEER RUN
<br />Mr. Littrell indicated that Mr. Don Inks, Community & Economic Development, South Bend,
<br />Indiana, has submitted a request to vacate the above referred to property. Mr. Gilot advised that the
<br />Board is in receipt of the following recommendations concerning this Vacation Petition from the
<br />Police Department, Fire Department, Sanitation, Department of Economic Development and the
<br />Department of Public Works. Area Plan does not recommend this right of way be vacated. Upon
<br />construction, this road will be the sole access to vacant developable land directly to the north of the
<br />current subdivision. If this right of way is vacated and the land to the north is developed, this would
<br />severely hinder owner and Fire Department access to the site. Under the South Bend Subdivision
<br />Ordinance 21-137(a), "the arrangement, character, extent, width, grade, and location of streets shall
<br />correlated to existing and planned streets ... and in their appropriate relation to the proposed uses
<br />of the land to be served by such streets." Engineering does not recommend vacation of this property.
<br />Their would be a loss of access to the adjacent property which will hinder the orderly growth of the
<br />neighborhood. Mr. Inks made a motion that the Clerk send a letter to the petitioner addressing these
<br />concerns, and sending an unfavorable recommendation to the petitioner. Mr. Littrell seconded the
<br />motion which carried.
<br />APPROVAL OF RECOMMENDATION - TO CONDUCT THE "WALK TO CURE DIABETES"
<br />Mr. Gilot stated that favorable recommendations have been received by Traffic and Lighting, Park
<br />Department, Police Department and the City Attorney's office, in reference to a request as submitted
<br />by Ms. Beth Ernsberger, 204 Ironwood Circle, South Bend, Indiana to conduct the above referred
<br />to walk, on September 21, 2003, from 12:00 p.m. to 3:00 p.m. on the designated route as submitted.
<br />Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the recommendation was
<br />approved.
<br />APPROVE TRAFFIC CONTROL DEVICE
<br />Upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried, the following traffic control
<br />device was approved, temporarily for June 28, 2003 only:
<br />New Installation - No North side of Wenger Street, In response to contracted
<br />Parking Marietta to Rush improvements.
