<br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF
<br />SOUTH BEND, INDIANA, APPROVING THE TRANSFER OF REAL PROPERTY
<br />TO LIFE CHALLENGES FOUNDATION, INC.
<br />WHEREAS, the City of South Bend, Indiana (the "City") has made an offer to purchase from
<br />the State of Indiana the following described real property situated in St. Joseph County, Indiana:
<br />Lots Numbered One (1), Two (2), Three (3) and Four (4) in block numbered Three
<br />(3) as shown on the Recorded Plat of William S. Vail's Addition to the town, now
<br />city, of South Bend,
<br />Commonly known as 201 S. William Street, South Bend, Indiana; and
<br />WHEREAS, under Indiana Code 36-9-6-3, the Board of Public Works of the City of South
<br />Bend has custody of and may maintain all real property of the City of South Bend; and
<br />WHEREAS, Indiana Code 36-1-11-1(b)(7) permits the City, acting by and through the Board
<br />of Public Works ("Board") to transfer property to an Indiana non-profit corporation, exempt from
<br />income taxation under 5010 of the Internal Revenue Code, under such terms and conditions as
<br />determined by the Board; and
<br />WHEREAS, the City, through the Board, is desirous of transferring the Real Property to Life
<br />Challenges Foundation, Inc., a nonprofit corporation, exempt from income taxation under 5010 of
<br />the Internal Revenue Code, for use as its new offices; and
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS FOR
<br />THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
<br />1. The transfer of Real Property described herein and situated in St. Joseph County, Indiana:
<br />Lots Numbered One (1), Two (2), Three (3) and Four (4) in block numbered Three
<br />(3) as shown on the Recorded Plat of William S. Vail's Addition to the town, now
<br />city, of South Bend.
<br />Commonly known as 201 S. William Street, South Bend, Indiana.
<br />for Three Hundred Fifty Thousand Dollars ($350,000), by the City of South Bend, Indiana to Life
<br />Challenges Foundation, Inc. shall be, and hereby is, approved.
<br />2. The transfer shall take place at a simultaneous closing at the time the City acquires the
<br />title to the property from the State of Indiana.
<br />3. The Clerk of the Board of Public Works shall cause the recording of the quitclaim deed
<br />conveying the Real Property to Life Challenges Foundation, Inc., upon receipt of the same.
<br />Adopted at a meeting of the Board of Public Works of the City of South Bend held on this
<br />14th day of April 2003, at 1308 County -City Building, 227 West Jefferson, South Bend, Indiana
<br />46601.
