REGULAR MEETING JUNE 8, 2009 There being no one present wishing to speak to the Council either in favor of or in opposition to this bill, Councilmember Dieter made a motion for favorable recommendation to full Council concerning this bill as substituted. Councilmember Oliver Davis seconded the motion which carried by a voice vote of eight (8) ayes. BILL NO. 27-09 PUBLIC HEARING ON A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING VARIOUS PARTS OF SECTION 6-26 OF CHAPTER 6, ARTICLE 6, OF THE SOUTH BEND MUNICIPAL CODE PERTAINING TO LOW VOLTAGE CONTRACTORS Councilmember Dieter made a motion to continue this bill indefinitely. Councilmember Varner seconded the motion which carried by a voice vote of eight (8) ayes. BILL NO. 29-09 PUBLIC HEARING ON A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 14 OF THE SOUTH BEND MUNICIPAL CODE BY THE INCLUSION OF NEW ARTICLE 10 ENTITLED USER FEES FOR SPECIAL PUBLIC SAFETY SERVICES PROVIDED BY THE SOUTH BEND POLICE DEPARTMENT Councilmember Dieter made a motion to continue this bill indefinitely. Councilmember Oliver Davis seconded the motion which carried by a voice vote of eight (8) ayes. BILL NO. 38-09 PUBLIC HEARING ON A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING FUNDS FOR CAPITAL EXPENDITURES FOR THE FISCAL YEAR 2009 FROM THE WATER WORKS DEPRECIATION FUND (#622) AND THE SEWAGE WORKS DEPRECIATION FUND (#642) Councilmember White made a motion to hear the substitute version of this bill. Councilmember Dieter seconded the motion which carried by a voice vote of eight (8) ayes. Councilmember Oliver Davis, Chairperson, Utilities Committee, reported that this committee held a Pubic Hearing on this substitute bill this afternoon and voted to send it to the full Council with a favorable recommendation. th Mr. Gary Gilot, Director, Public Works, 13 Floor County-City Building, 227 W. Jefferson Blvd., South Bend, Indiana, made the presentation for this bill. Mr. Gilot advised that this substitute bill includes capital items which are referenced in Exhibit A and attached to the bill. He noted that the Water Works Fund #622 would appropriate $1,107,100 for various main extensions, buying water meters and repairing pumps and roofs. He further noted that capital items will be paid from Environmental Services Fund #641 in the amount of $3,367,000; and $245,300 from Sewers. Mr. Gilot noted that several trucks would be rehabilitated and that there would be a more efficient use of saving of labor costs. He further noted that no property taxes dollars are involved with this appropriation and that these expenditures are coming out of user fees. 9
