REGULAR MEETING JUNE 8, 2009 <br /> <br /> <br /> <br /> <br />BILL NO. 35-09 PUBLIC HEARING ON A BILL TO <br /> VACATE THE FOLLOWING <br /> DESCRIBED PROPERTY: THE ALLEY <br /> TO BE VACATED IS THE FIRST <br /> NORTH/SOUTH ALLEY WEST OF MAIN <br /> STREET FROM WAYNE STREET <br /> SOUTH TO THE FIRST EAST/WEST <br /> ALLEY FOR A DISTANCE OF 198 FEET, <br /> MORE OR LESS AND A WIDTH OF 14 <br /> FEET. SAID ALLEY IS A PART OF THE <br /> ORIGINAL PLAT OF THE TOWN, NOW <br /> CITY OF SOUTH BEND, PORTAGE <br /> TOWNSHIP, ST. JOSEPH COUNTY, <br /> INDIANA <br /> <br />Councilmember Varner, Chairperson, Public Works and Property Vacation Committee, <br />reported that this committee met this afternoon on this bill and sends it to the Council <br />with a favorable recommendation. <br /> <br />Judy Jankowski, AT& T, 307 S. Main Street, Suite 145, South Bend, Indiana, made the <br />presentation for this bill. <br /> <br />Ms. Jankowski advised that they are seeking to vacate the property to provide better <br />access, security, and safer traffic flow of the redesigned parking lot adjacent to the AT&T <br />Building at 307 S. Main Street. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Dieter made a motion for favorable <br />recommendation to full Council concerning this bill as substituted. Councilmember <br />Oliver Davis seconded the motion which carried by a voice vote of eight (8) ayes. <br /> <br /> <br />BILL NO. 37-09 PUBLIC HEARING ON A BILL TO <br /> VACATE THE FOLLOWING <br /> DESCRIBED PROPERTY: THE ALLEY <br /> TO BE VACATED IS THE FIRST <br /> NORTH/SOUTH ALLEY WEST OF <br /> ALLEN STREET FROM LINCOLN WAY <br /> WEST TO LINDSEY STREET FOR A <br /> DISTANCE OF 146.2 FEET AND A <br /> WIDTH OF 14 FEET <br /> <br />Councilmember Varner, Chairperson, Public Works and Property Vacation Committee, <br />reported that this committee met this afternoon on this bill and sends it to the Council <br />with a favorable recommendation. <br /> <br />Mr. Wadad Elummori, 51343 Lilac Road, South Bend, Indiana, made the presentation for <br />this bill. <br /> <br />Mr. Elummori advised that they are seeking the vacation for safety reasons and so that <br />they can consolidate the two (2) properties on either side of the alley. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br /> <br /> <br /> 8 <br /> <br />
