REGULAR MEETING SEPTEMBER 22, 2008 <br /> <br /> <br /> <br />th <br />Mr. Charles Clark, License Auditor, Department of Administration and Finance, 12 <br />Floor County-City Building, South Bend, Indiana, made the presentation for this bill. <br /> <br />Mr. Clark advised that in accordance with the procedure for the renewal of City <br />Business/Occupational licenses for the operation of Scrap Metal/Junk Dealers/Recycling <br />Operations, applications for seven (7) businesses were submitted to the Police <br />Department, Fire Inspection Bureau, Water Works, Department of Code Enforcement <br />and Building Department. Included in the seven were applications for two (2) new <br />businesses Alternative Two, LLC and Omni Source Corporation, both of which are <br />located on sites previously licensed and used for this purpose. Mr. Clark noted that the <br />properties were inspected for Fire Code violations, environmental violations, proper <br />maintenance of the premises and areas outside the fences, the height and condition of the <br />surrounding fencing and, compliance with record keeping and security requirements. All <br />applications received favorable recommendation from all departments. Mr. Clark stated <br />that the applicants have met all of the technical requirements of the ordinance. <br /> <br />A Public Hearing was held on the Resolution at this time. <br /> <br />There being no on present wishing to speak to the Council either in favor of or in <br />opposition to this Resolution, Councilmember Dieter made a motion to adopt this <br />Resolution. Councilmember Oliver Davis seconded the motion which carried and the <br />Resolution was adopted by a roll call vote of nine (9) ayes. <br /> <br /> <br />RESOLUTION NO. 3910-08 A RESOLUTION OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, <br /> TRANSFERRING TO MADISON CENTER <br /> $43,656.00 OF UNITED STATES DEPARTMENT <br /> OF HOUSING AND URBAN DEVELOPMENT <br /> SHELTER PLUS CARE GRANT FUNDS <br /> WITHIN FUND NO. 212 <br /> <br /> <br /> WHEREAS, on May 27, 2008 this Council passed Ordinance No. 9840-08 which <br />appropriated a total of $178,320.00 in United States Department of Housing and Urban <br />Development (HUD) grant funds of which $43,656.00 was designated for AIDS <br />Ministries/AIDS Assist and the balance for Madison Center; and <br /> <br /> WHEREAS, The South Bend Division of Community Development has recently <br />learned that AIDS Ministries/AIDS Assist cannot accept the funds appropriated for its <br />use in Ordinance No. 9840-08; and <br /> <br /> WHEREAS, the sum of $43,656.00 designated for distribution to AIDS <br />Ministries/AIDS Assist by Ordinance No. 9840-08, should be transferred to Madison <br />Center. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF <br />THE CITY OF SOUTH BEND, INDIANA, as follows: <br /> <br /> Section I. The sum of $43,656.00 within Fund 212 previously appropriated by <br />Ordinance 9840-08 for distribution to AIDS Ministries/AIDS Assist shall be transferred <br />to Madison Center, <br />the other sub grantee of HUD funds in Ordinance 9840-08, to be administered by the <br />Division of Community Development. <br /> <br /> Section II. This Resolution shall be in full force and effect from and after its <br />adoption by the Council and approval by the Mayor. <br /> <br /> <br /> s/Timothy A.
