Responsible Animal and Pet Ownership Care and Control Regulation Ordinance <br />Page 6 <br />3.Persistence, despite this failure, in accumulating and controlling animals. <br />(k) Animal welfare organization: Any group maintaining a 501(c) 3 status with the primary <br />purpose of promoting animal health, safety, or adoption or the prevention of animal <br />cruelty. Organizations described in section 501(e) (3) are commonly referred to as <br />charitable organizations or non -profit organizations, as per Internal Revenue Service <br />standards. The animal welfare organization's IRS letter of determination must be on file <br />with South Bend Animal Care and Control. <br />(1) At large animal: Any animal not under restraint or control. This section does not apply to <br />free - roaming and /or community cat(s). <br />(m)Attack: When the animal exhibits one or more of the following behaviors, including, but <br />not limited to: snarling, biting, baring teeth, chasing, growling, barking, snapping, <br />pouncing, lunging. . <br />(n) Auction: Any place or facility where animals are regularly bought, sold or traded, except <br />for those facilities otherwise defined in this Chapter or by Indiana state law. <br />(o) Breeder: Any person who intentionally or accidentally causes the breeding of an animal <br />or makes an animal cat or dog available for breeding purposes, or any person who offers <br />for sale, sells, trades, receives other compensation or gives away any litter of dogs or <br />cats; or any person who has unaltered animals who habitually (two or more litters) have <br />accidental litters.5 <br />(p) Bite: To seize or cut with the teeth, breaking the skin <br />(q) Business day: Monday through Friday, except for federal or state holidays. <br />(r) Caretaker: A person who provides food, water and shelter for free - roaming and /or <br />community cat(s). _ <br />(s) Cattery: Any person or group of persons, partnership or corporation engaged in keeping <br />more than one (1) unaltered cat for the purposes of breeding. <br />(t) City: City of South Bend, Indiana. <br />(u) Community cat: An unowned, outdoor cat that has been evaluated and sterilized by a <br />licensed veterinarian, ear tipped and released back into the area from which it was <br />captured and is cared for by a caretaker. <br />'Indiana Code 15 -21 sets forth "Commercial Dog Breeder Regulations". <br />e Indiana Code § 15- 20 -1 -3 sets forth the regulations address "dog bite liability ".
