Responsible Animal and Pet Ownership Care and Control Regulation Ordinance <br />Page 5 <br />(a) Abandon: To knowingly, intentionally, or recklessly leave unattended, without proper <br />food, water, or shelter, for 24 hours or more, in or about a building or structure or any <br />portion thereof on or about any propert y.2 <br />(b) Adequate shelter: A structure designed specifically to shelter an animal that allows an <br />animal to maintain its body heat, with a roof, structured floor and three sides free of leaks <br />or openings to the wind and rain, and a fourth side allowing access that is protected from <br />the elements. The structure is physically located in a dry area allowing the animal dry <br />keeping and access outside the structure to dry ground that is mud free. Livestock require <br />a structure with three sides and a roof designed to protect from the elements. <br />(c) Altered animah An animal that has been operated on to prevent it from procreating. <br />(d) Animal: Any living vertebrate, domestic or wild, except a human being.' <br />(e) Animal Concession: Any person, group of persons, partnership, or corporation who for <br />compensation has any animal available for hire or on display. <br />(f) Animal Control Commission: The Animal Control Commission shall be an advisory <br />Commission with regard to policy and fiscal decisions affecting the Division of Animal <br />Care and Control, with the Common Council having final authority regarding fiscal <br />matters. <br />(g) Animal Control Officer: A person authorized to carry out the provisions of this Chapter. <br />(h) Animal event: Display, activity or show of wild or domestic animals in a shopping <br />center, retail establishment, adjacent lot, or elsewhere. <br />(i) Animal fighting paraphernalia: Equipment or items used to train or condition animals <br />for participation in an animal fighting contest or materials to promote animal fighting, the <br />breeding of animals specifically for the purpose of fighting, train animals for fighting, or <br />to track the results of animal frghts.4 <br />0) Animal hoarder: Any person who: <br />1. Having one or more than animals and failing to provide adequate standards of <br />nutrition, sanitation, shelter, and veterinary care, with this neglect often resulting <br />in illness and death from starvation, spread of infectious disease, and untreated <br />injury or medical condition, or <br />2.Denial of the inability to provide this minimum care and the impact of that failure <br />on the animals, the household, and human occupants of the dwelling, or <br />' Indiana Code § 25- 38.1 -4 -8 sets forth regulations addressing "abandoned animals" and the role of a veterinarian. <br />Indiana Code § 35- 46 -3 -7, Version A addresses abandonment or neglect effective through July 1, 2014 and Indiana <br />Code § 35- 46 -3 -7, Version B sets forth regulations addressing abandonment and neglect which become effective <br />July 1, 2014. <br />'Indiana Code § 25- 38.1 -1 -5 defines an animal as including "birds, fish, mammals and reptiles wild or domestic ". <br />Indiana Code § 35- 46 -3 -4.3 defines "animal fighting paraphernalia ". <br />
