REGULAR MEETING DECEMBER 9, 2013 <br /> <br /> <br /> <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this bill, Councilmember Dieter made a motion for favorable recommendation to full Council <br />concerning this bill, Councilmember Oliver Davis seconded the motion which carried by a voice <br />vote of eight (8) ayes. <br /> <br /> <br />BILL NO. 74-13 PUBLIC HEARING ON A BILL OF THE COMMON <br /> COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br /> AMENDING THE 2013 SALARY ORDINANCE NO. <br /> 10199-12 FOR APPOINTED OFFICERS AND NON- <br /> BARGAINING EMPLOYEES OF THE CITY OF SOUTH <br /> BEND, INDIANA TO ADDRESS CERTAIN ZOO <br /> EMPLOYEE COMPENSATION <br /> <br /> <br />Councilmember Varner, Chairperson Personnel & Finance Committee, reported that this <br />committee held a Public Hearing on this bill this afternoon and sends it to the full Council with a <br />favorable recommendation. <br /> <br />th <br />Mr. Mark Neal, City Controller, 12 Floor County-City Building, 227 W. Jefferson Blvd., South <br />Bend, Indiana, made the presentation for this bill. <br /> <br />Mr. Neal advised that this bill would amend the 2013 Non-Bargaining Employee and Office <br />Salary Ordinance No. 10199-12 passed by the Common Council on October 29, 2012. The <br />amendment is a new Section “V” addressing special compensation payable to Potawatomi Zoo <br />employees. Mr. Neal stated that this ordinance makes no adjustments in the salaries that were <br />fixed in the 2013 Non-bargaining Salary Ordinance. However, the City is in the process of <br />entering into a public/private partnership agreement with the Potawatomi Zoological Society for <br />operation of the Potawatomi Zoo. The agreement is expected to be approved by the Park <br />Commission around December 16, 2013. As a result certain current employees of the City will <br />become employees of the Society. Because this will result in cessation of their rights and <br />privileges as public employees under the Public Employees Retirement Fund “PERF”, the <br />agreement will provide certain unique final compensation to these employees who are affected <br />by the agreement. Upon approval of the agreement those employees who will cease being <br />employees of the City of South Bend shall be entitled to receive a one-time payment equal to all <br />accrued, unused vacation and sick pay as of the date of change in their employment status. Mr. <br />Neal also noted that such affected employee with less than ten years of PERF qualified City <br />service shall further be entitled to receive a sum equal to Seven Hundred Fifty Dollars per year <br />($750.00) for each such year of service as an employee of the City of South Bend, pro-rated for <br />any partial year of City employee service.
