REGULAR MEETING MAY 24 1965 <br />REPORT OF CITY PLANNING COMMISSION <br />May 13, 1965 <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />The attached petition of Joseph and Tina Zappia was legally advertised on March 22, 1965 and given public <br />hearing on April 1, 1965. The following action was taken: <br />After due consideration the Commission found the commercial <br />use of subject property would be an unwarranted extension <br />into a residential neighborhood; that ample commercial property <br />exists; that the property is not necessarily commercial in <br />nature; that residential uses exist to the north and to the <br />west; that there is no demonstrated need for additional commercial <br />land in the vicinity; that, in fact, there exists approximately <br />1800 feet of unused commercial zoning between Edison and South <br />Bend Avenue on Ironwood and that therefore sufficient commercial, <br />sufficient vacant commercial as well as commercially zoned land <br />not used for commercial purposes exists in the area. Motion carried. <br />ORDINANCE NO. 4755 - -65 <br />AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN MUNICIPAL <br />BONDS OF 1961 - $25,416.76. <br />The ordinance was given third reading and passed by a roll call vote of 8 ayes - 1 absent (Councilman Glass). <br />ORDINANCE NO. 4756 - -65 <br />AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN MUNICIPAL <br />BONDS OF 1962 - $219,060.38. <br />The ordinance was given third reading and passed by a roll call vote of 8 ayes - 1 absent (Councilman Glass). <br />ORDINANCE <br />ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 <br />(Southwest corner of Ryer St. and Lincoln Way West) <br />The ordinance was given third reading and lost by a roll call vote of 3 ayes (Councilmen Hunter, Wise and Geib), <br />5 nays (Councilmen Allen, Palmer, Szymkowiak, Smith and Muszynski). <br />ORDINANCE NO. 4758 - -65 <br />AN ORDINANCE REPEALING SECTIONS 16 TO 36, INCLUSIVE, OF <br />CHAPTER 35 OF ORDINANCE NO. 4608 -63, BEING THE MUNICIPAL <br />CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, RELATTNG <br />TO EXCAVATIONS AND OBSTRUCTIONS IN STREETS, ALLEYS, AND <br />PUBLIC PLACES AND SUBSTITUTING NEW SECTIONS IN LIEU OF <br />THOSE REPEALED, AS AMENDED. <br />The ordinance, as amended, was given third reading and passed by a roll call vote of 7 ayes - 1 nay (Councilman <br />Allen), 1 absent (Councilman Glass). <br />ORDINANCE. FIRST & SECOND READING <br />AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS <br />OF SOUTH BEND; INDIANA, CERTAIN LANDS. <br />(Tract of land East of Miami Road near Jackson Road and <br />abutting present city limits on southern boundary) <br />The ordinance was given first reading by title and second reading in full. Councilman Smith made a motion that <br />the ordinance be set for public hearing on June 14, 1965. Councilman Geib seconded the motion. Motion carried. <br />ORDINANCE, FIRST & SECOND READING <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 <br />(1605 North Sheridan Street) <br />The ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that <br />the ordinance be set for public hearing on June 14, 1965. Councilman Szymkowiak seconded the motion. <br />Motion carried. <br />
