Huff /s/ <br />Director of Planning <br />RLH /cf <br />attach. <br />(Continued) <br />After due consideration the Commission found that <br />the proposed rezoning would tend to devaluate the <br />surrounding property and would result in spot zoning. <br />It was therefore duly moved, seconded and carried <br />that the petition be recommended unfavorably to the <br />Council. <br />Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Glass seconded <br />the motion. Motion carried. <br />REPORT OF CITY PLANNING COMMISSION <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />August 14, 1964 <br />The attached petition of the Humble Oil Company was originally filed October 11, 1963, considered by the Plan <br />Commission at their November meeting and recommended unfavorably to the Council on December 11, 1963. <br />Section 23 -(c) of the Zoning Ordinance reads as follows: "If the report of the Plan Commission is adverse to <br />the proposed change or amendment, the Ordinance shall not be passed except by a vote of at least seventy -five <br />(75) percentum of the members of the City Council. Failure of the City Council to pass such proposed ordinance <br />by said affirmative vote within ninety (90) days after its rejection by the Plan Commission shall constitute <br />rejection of the proposed ordinance and it shall not be reconsidered by the Planning Commission or the City <br />Council until the expiration of one (1) year after date of its original rejection by the Plan Commission." <br />In view of this section neither the Plan Commission nor the Council has the authority to act on the petition <br />until after December 11, 1964. <br />Very truly.yours, <br />CITY PLANNING COMMISSION <br />William D. Motion carried. <br />ORDINANCE NO. 4682--64 <br />AN ORDINANCE APPROPRIATING ($2,500.00) TO THE CITY CEMETERIES <br />DEPARTMENT FOR THE PURCHASE.OF A TRUCK; SAID ($2,500.00) TO BE <br />A TRANSFER FROM ACCOUNT N -12 =0 ACCOUNT N -722, ALL IN THE <br />GENERAL FUND. <br />The ordinance was given third reading and passed by a roll call vote of 8 ayes - 1 absent (Councilman Wise). <br />ORDINANCE NO. 4683 - -64 <br />AN ORDINANCE APPROPRIATING ($500.00) TO THE OFFICE OF THE CITY <br />CLERK FOR THE PURCHASE OF ADDITIONAL POSTAGE TO BE A TRANSFER <br />FROM ACCOUNT C -362 INTO ACCOUNT C -212, ALL IN THE GENERAL FUND. <br />The ordinance was given third reading and passed by a roll call vote of 8'ayes - 1 absent (Councilman Wise). <br />ORDINANCE NO. 4684 - -64 <br />AN ORDINANCE APPROPRIATING ($1500.00) TO THE ELECTRICAL DEPARTMENT <br />FOR THE PURCHASE OF A TRUCK; SAID ($1500.00) TO BE A TRANSFER FROM <br />ACCOUNT V -37 INTO ACCOUNT V -7222 ALL IN THE GENERAL FUND. <br />The ordinance was given third reading and passed by a roll call vote of 8 ayes - 1 absent (Councilman Wise). <br />ORDINANCE. FIRST & SECOND READING <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE <br />NO. 3702 <br />(South of Webster St., North of New York Central Railroad <br />and Grand Trunk Railway Company) <br />The ordinance was given first reading by title and second reading in full. Councilman Smith made a motion that <br />the ordinance be set for public hearing on September 28, 1964. Councilman Geib seconded the motion. Motion <br />carried. <br />
