_REGULAR MEETING FEBRUARY 10, 1964 <br />COMMUNICATION <br />A note to Council Members from Don, Delois and Al Palmer "Thanking you for your kind sympathy expressed in the <br />beautiful flowers received. <br />Councilman Glass made a motion that the communication be accepted and placed on file. Councilman Szymkowiak <br />seconded the motion. Motion carried. <br />COMMUNICATION <br />TO: CITY CLERK - CITY OF SOUTH BEND <br />FROM: COUNCIL - CITY OF SOUTH BEND <br />After the first two regular meetings of the Common Council of the City of South Bend, it has been recognized by <br />its members that an improvement can be made in the presentation of petitions to the Council. <br />By unanimous vote the Council has decided that a change in procedure is in order in the presentation of these <br />petitions. <br />Effective at the meeting of the Council on February 24, 1964, it will be a requirement that the petition give a <br />general description of the location of the property requested to be rezoned. <br />Such petition must be in the hands of the City Clerk on or before noon Wednesday of the meeting in which such <br />petition is presented to the Common Council. <br />It will also be necessary that there be presented to the City Clerk eleven (11) copies of each petition- -one each <br />for the nine Councilmen- -one for the City Clerk and one for the City Planning Commission. <br />Councilman Geib made a motion that the communication be accepted and placed on file. Councilman Palmer seconded <br />motion. Motion carried. <br />REPORT OF CITY PLANNING COMMISSION <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />December 111 1963 <br />The attached petition of the Humble Oil Company to rezone from "B" Residential Use and "B" Height and Area District <br />to "C" Commercial Use and "B" Height and Area District the property generally described as being the southwest <br />corner of Lincoln Way West and Ryer Street was legally advertised under date of October 28, 1963 and given public <br />hearing on November 7, 1963. The following action was taken; <br />After due consideration the Commission found that sufficient commercial <br />j zoning and land use existed in the general area; that this would be an <br />unnecessary and unwarranted intrusion into a residential neighborhood; <br />that it would result in a continuation of strip zoning. Motion carried. <br />REPORT OF CITY PLANNING COMMISSION <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />February 7, 1964 <br />The attached petition of the Common Council to amend Section 17 -A of Ordinance No. 3702, the Zoning Ordinance of <br />the City of South Bend, Indiana was legally advertised under date of January 16, 1964 and given public hearing on <br />January 27, 1964. The following action was taken: <br />After due consideration it was duly moved, seconded, and unanimously carried that the <br />following resolution be adopted: <br />BE IT RESOLVED, that the tlanning Commission finds: <br />1. That the proposed amendment to the Zoning Ordinance would under ordinary circumstances <br />be a desirable amendment. <br />2. That one of the purposes of the Zoning Ordinance is to promote the general welfare of the City. <br />3. That the proposed amendment if adopted at the present time would prohibit the use of certain <br />areas for the purposes for which the City is presently committed to use such areas. <br />(Continued) <br />
