REGULAR MEETING MAY 13 1974 <br />REGULAR MEETING - RECONVENED (CONTINUED) <br />PETITIONS TO AMEND ZONING ORDINANCE (CONTINUED) <br />I(We), the undersigned, do hereby respectfully make application and petition the <br />Common Council of the City of South Bend, Indiana, to amend the Zoning Ordinance of the <br />City of South Bend as hereinafter requested, and in support of this application, the <br />following facts are shown: <br />1. The property sought to be rezoned is located at 2822 South Michigan Street. <br />2. <br />The property is owned <br />by Dr. Ronald <br />Milovich, Optometrist. <br />3. <br />A legal description of <br />the property <br />is as follows: <br />The front of this site has been excavated (approx. 3 foot bank)to the <br />sidewalk level. The front of the house on the north side has an extending <br />brick wall, the south side also has an extended brick wall, also on the <br />south side is an entrance. The front area has a patio, the center which <br />is about 15 feet long and has a half circle of flower bed with an aluminum <br />post and a sign with the names of the two doctors, Dr. Ronald Milovich and <br />Associate, Dr.. James A. Van Fleit. <br />The front of the house has an entrance and is constructed with face brick. <br />The inside has a waiting room for about five chairs, a receptionist's room, <br />two examination rooms, a large fitting room and a laboratory. The back area <br />is black- topped with dry well with provisions for 10 -12 parking spaces. <br />4. It is desired and requested that the foregoing property be rezoned from "B" <br />Use and "B" Height and Area District to "C" Use and "C" Height and Area <br />District. <br />5. It is proposed that the property will be put to the following use and the <br />following building will be constructed: offices for two optometrists. <br />6. Number of off - street parking spaces to be provided: 12 parking spaces, <br />blacktop and 1200 gal. dry well. <br />7. Attached is (a) an original ordinance and 25 copies; (b) an original petition <br />and 20 copies; (c) a $10 filing fee; (d) an existing plot plan showing my <br />property and other surrounding properties; (e) names and addresses of all <br />the individuals, firms or corporations owning property within 300 feet of <br />the property sought to be rezoned; and (f) 5 copies of a site development <br />plan. <br />s/ Dr. Ronald Milovich <br />Petitioner <br />I(We), the undersigned, do hereby respectfully make application and petition the <br />Common Council of the City of South Bend, Indiana, to amend the Zoning Ordinance of the <br />City of South Bend as hereinafter requested, and in support of this application, the <br />following facts are shown: <br />1. The property sought to be rezoned is located at:- Multiple parcels of <br />property on the south side of East Jefferson Boulevard, on the east and <br />west sides of 35th Street in South Bend, Indiana; and more commonly <br />located in those portions of the 3500 and 3600 blocks of East Jefferson <br />Boulevard. <br />2. The property is owned by Whitmore Corporation, 3618 East Jefferson <br />Boulevard, South Bend, Indiana. <br />3. A legal description of the property is as follows:` <br />Lots 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17 and 18 of Jerome's First <br />Addition to the City of South Bend, Indiana; <br />Lots 1, the south half of Lot 8, the south half of Lot 9, Lots 13, 14 <br />and 15 of Plat of Fernwood, City of South Bend, Indiana; and <br />A parcel of property adjacent to Jerome's First Addition and described <br />as follows: <br />A part of the North Half (1/2) of the Southeast Quarter of Section Eight <br />(8), Township Thirty -seven (37) North, Range Three (3) East, which part <br />is bounded by a line running as follows, viz: Beginning on the North <br />line of the right -of -way of the Grand Trunk Western Railway Company <br />which point is 308.32 feet East of the intersection of the East line <br />of 32nd Street in the City of South Bend, and the North line of the <br />said right -of -way of the Grand Trunk Western Railway Company, thence <br />East from said point of beginning along the North line of said railroad <br />right -of -way 145.83.feet, more or less, to the Southwest corner of Lot <br />18, as shown on the recorded Plat of Jerome's First Addition to the <br />City of South Bend, thence North 190.23 feet to the Southwest corner <br />of Lot 7 as shown on the recorded Plat of Jerome's First Addition, <br />thence West 148 feet, more or less, to the Northeast corner of a tract <br />of land conveyed by the grantors herein to the St. Joseph County Chapter <br />of the National Red Cross on December 11, 1967; thence South 190 feet, <br />more or less, to the place of beginning. <br />
