REGULAR MEETING NOVEMBER 13, 1973 <br />11REGULAR MEETING - RECONVENED (CONTINUED) <br />Mr. Farrand stated that part of the contract says the city will approve the project. Councilman <br />Miller wondered if the cost of the project could be cut by the Council. Mr. Farrand reminded the <br />Council that they were not appropriating money at this time and that he would be coming back to the <br />Council for that in the future. Councilman Taylor asked about the deadline to be met. Mr. Farrand <br />,stated that the original proposal was that the contract must be signed and in the offices of HUD by <br />November 15. He stated that, at present, the city did not even have the contract. Miss Virginia Guthrie, Executive Secretary of the Civic <br />Planning Association, wondered if the Council was approving something they did not really know any <br />thing about. Mr. Farrand stated that what she had said was partially true; however, he had provid <br />a copy of a similar contract to Councilman Horvath for the'Council's perusal. Council President <br />Nemeth questioned the method of approving the contract. Mr. James Roemer, City Attorney, stated <br />that, when the federal government prepares the contract, they "call the shots ". Miss Guthrie aske <br />if Council President Nemeth, in his own business, would approve a contract that he had not seen. <br />,Council President Nemeth stated that the Council was only giving the Mayor authority to enter into <br />a contract and the Council must rely on the Mayor's judgment. He stated that appropriation of the <br />contract would come back to the Council for approval. <br />11ORDINANCES, FIRST READING <br />11ORDINANCE NO. 5604 -73 <br />AN ORDINANCE APPROVING THE FORM AND <br />TERMS OF LEASE AND TRUST INDENTURE AND <br />ECONOMIC DEVELOPMENT REVENUE BONDS, AND <br />AUTHORIZING THE EXECUTION THEREOF PER- <br />TAINING TO ESLINGER TV & APPLIANCES, <br />INC. <br />This ordinance had first reading. Councilman Taylor made a motion to suspend the rules and take <br />action on the ordinance, seconded by Councilman Kopczynski. The motion carried by a roll call vot <br />of nine ayes (Councilmen Serge, Szymkowiak, Miller, Parent, Taylor, Kopczynski, Horvath, Newburn <br />and Nemeth). This ordinance had second reading. Mr. Kenneth Fedder, attorney for the South Bend <br />Development Commission, indicated that, on page 2, the date of November 13 should be inserted in <br />the blank line. Councilman Taylor made such a motion, seconded by Councilman Kopczynski. The <br />motion carried. Councilman Horvath made a motion that the ordinance, as amended by the insertion <br />of the date, be passed, seconded by Councilman Kopczynski.
